<br /> and expressed concern with annexing areas and not providing all City
<br /> services. She was concerned about the fire response time. She
<br /> stated she knows our next planned unit for fire protection is out
<br /> that way, but that is not planned for awhile yet. Mr. Hart stated
<br /> the City is not obligated to ever provide wastewater, and Mr. Taylor
<br /> stated that is correct.
<br /> Mayor Moore introduced for consideration a public hearing and
<br /> adoption of a Zoning Ordinance, the caption which was read as
<br /> follows:
<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING
<br /> LOT 17, RIVER RIDGE SUBDIVISION, LOCATED AT 307 RIVER RIDGE
<br /> PARKWAY, - FROM "PUD" (PLANNED UNIT DISTRICT) TO "P" (PUBLIC AND
<br /> INSTITUTIONAL DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND
<br /> PROVIDING FOR PENALTIES.
<br /> Mayor Moore opened the public hearing and asked if anyone wished to
<br /> speak. No one did, so Mayor Moore closed the public hearing. Mr.
<br /> Guerra moved for adoption of the Ordinance and Mr. Hart seconded the
<br /> motion, which passed unanimously. ~

<br /> representing BMC Real Estate, owner of the property, stated they
<br /> request support for approval. No one else wished to speak, so Mayor
<br /> Moore closed the public hearing. Mr. Guerra moved for adoption of
<br /> the Zoning Ordinance and Mr. Hernandez seconded the motion, which
<br /> passed unanimously.
<br /> Mayor Moore introduced for consideration adoption of an Ordinance on
<br /> emergency, the caption which was read as follows:
<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96
<br /> FISCAL YEAR TO PROVIDE FUNDING FOR RACQUETBALL COURTS IN THE
<br /> ACTIVITY CENTER PROJECT AND DECLARING AN EMERGENCY.
<br />! Mr. Guerra moved for adoption of the Ordinance on emergency and Mr.
<br />i Mihalkanin seconded the motion. Mr. Gilley advised the Council the
<br />,
<br /> Activity Center will open in April, and these courts are under
<br /> construction now. There is no funding to finish them. This
<br /> $80,000.00 was earmarked for a match with Texas Parks and Wildlife
<br /> that did not occur, and this will finish the courts. The Council
<br /> voted unanimously for adoption of the Ordinance on emergency.
