<br />141 <br />Regular Meeting September 23, 1996 Page 8 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING ARTICLE 2, POLICE DEPARTMENT, OF CHAPTER 62, <br /> PUBLIC SAFETY OF THE CITY CODE BY DELETING DIVISION 2, POLICE <br /> RESERVE FORCE, SECTIONS 62.056-62.063; REMOVING CURRENT RESERVE <br /> OFFICERS FROM THE FORCE; AND INCLUDING PROCEDURAL PROVISIONS. <br />Mr. Guerra moved for approval of the Ordinance on first reading and <br />Mr. Hart seconded the motion. Mr. Guerra asked what Sgt. Glasgow <br />would do now the Reserves Program is going away, and Mr. Gilley <br />advised his duties would be reassigned to patrol. Mr. Guerra asked <br />if there was going to be a request for an upgrade of this position, <br />and Chief Kendrick advised there would be. Mr. Gilley advised two <br />of the Reserves were volunteering for the Park Patrol. The Council <br />voted unanimously for approval of the Ordinance on first reading. <br />Mayor Moore introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, EXTENDING THE HOURS FOR THE ON-PREMISE SALE OF MIXED <br /> BEVERAGES AND BEER IN THE CITY FOR A TRIAL PERIOD BEGINNING <br /> NOVEMBER 8, 1996 AND ENDING MAY 8, 1997; INCLUDING PROCEDURAL <br /> PROVISIONS AND PROVIDING FOR PENALTIES. ~ <br />Mr. Hernandez moved for approval of the Ordinance on first reading <br />and Ms. Hughson seconded the motion. Mayor Moore stated the Council <br />has received extensive commentary and have held public hearings, <br />and the Council has previously voted on this issue but it did not <br />pass. Ollie Giles stated she wants the Council to vote this down. <br />Mayor Moore stated this would be for a trial period from November 8 <br />to May 8 to extend legal hours from 12:00 to 2:00 a.m. and he favors <br />having a trial period which will give us a base line and evidence to <br />base future decisions. Ms. Hughson expressed concern because there <br />is no suggested measurement criteria ,to measure at the end of the <br />test. She said it has been stated we have no measurement on either <br />side as to what will happen if we go to 2:00 a.m., but when we are <br />at the end of the trial period, we will need something to measure. <br />Mayor Moore stated there have been changes during the time this <br />issue has been discussed, which would affect the baseline data. <br />Some of those changes include the increase in downtown patrol soon <br />to occur, the change in legal drinking age, the community's rapid <br />growth, and the tremendous increase in commuter students at the <br />University. Mayor Moore stated he assumes the Police Department <br />will be able to track from this point MIPs, public disorderliness, <br />vandelism and burglaries. Ms. Hughson stated she does not think any <br />of those changes, including two additional officers is reason to not <br />have any kind of measurement data. Mayor Moore stated we have to <br />determine where to measure from and does not recall the Council in <br />prior discussions ever determining what methodology would be used <br />and if there is any better methodology than using the downtown and <br />neighborhood people and police to track it for us. Ms. Hughson <br />stated this would just be anecdotal data as we now have. Mayor <br />Moore does not think there is any hard data to gather. Mr. Cox <br />recalls a majority of the Council agreeing there would be an attempt <br />to quantify in a reasonably objective manner the data and was the <br />proposed reason for the test. Mr. Guerra stated if Ms. Hughson <br />wants to suggest something for the next meeting, the Council can <br />consider it. Ms. Hughson wants to see the list the Council was <br />previously provided. Mr. Manning stated if the Council adopts any <br />methodology of measurement, many factors need to be considered. The <br />time of offenses or complaints need to be taken into consideration. <br />Mr. Guerra does not recall the discussion of measurement, but if it <br />was discussed, he would be willing to see these at the second <br />reading to incorporate into the discussion and/or Ordinance. Ms. <br />Hughson asked Mr. Taylor if the measurement criteria needed to be in <br />the Ordinance, and he stated it was not the last time, but it was a <br />part of the Council's overall consideration.
