Mr. Hernandez left the meeting at this time (9:15 p.m.). <br /> Mayor Moore introduced for consideration adoption of an Ordinance on <br /> third and final reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, INCREASING SEWER RATES ESTABLISHED UNDER SECTION 86.262 <br /> OF THE SAN MARCOS CITY CODE; AND INCLUDING PROCEDURAL <br /> PROVISIONS. <br /> Mayor Moore stated the Ordinance has been revised to adopt on <br /> emergency in order for the rates to go into effect at the start of <br /> the fiscal year. Mr. Guerra moved for adoption of the Ordinance and <br /> approval for amendment to adopt on emergency and Mr. Hart seconded <br /> the motion. Ms. Hughson stated she will vote for the Ordinance but <br /> doing it on emergency bothers her. Mr. Mihalkanin agreed with Ms. <br /> Hughson's comments. Mr. Cox asked for the data regarding Mr. <br /> McNair's question of the rates for duplexes. Mr. Gilley stated, <br /> Staff has determined the average annual consumption for duplexes <br /> typically falls below the 16,000 gallon cap (two residential units <br /> with 8,000 gallons each). The calculated average in most instances <br /> falls below 16,000 gallons per month, but in almost every case on a <br /> month to month basis, they have exceeded 16,000 gallons occasionally <br /> throughout the year, some considerably and some just barely over. <br /> If the Council wants to treat duplexes as two single-family <br /> residences with a cap of 16,000 gallons, all of them would benefit <br /> from time to time throughout the year. On the average most of them <br /> would fall below that. Staff can re-evaluate how all wastewater <br /> services are charged using cost of service, calculations, etc., but <br /> there is a number of expenditures that needs to be spread out over <br /> the entire rate base, and the cost would simply have to be shifted. <br /> Mr. Cox stated Mr. McNair felt this was an inequity issue, and Mr. <br /> Cox now hears Staff does not consider this to be an inequity issue <br /> over the course of a whole year. Ms. Hughson asked if duplexes are <br /> averaging 16,000 gallons, and Mr. Gilley stated they calculated <br /> duplexes average 10-12,000 gallons per duplex. The Council voted <br /> unanimously for adoption of the Ordinance on emergency. <br /> Mayor Moore introduced for consideration approval o£ minutes of the <br /> Regular Meeting held September 9, 1996, approval of two Ordinances <br /> on second reading, adoption of nine Resolutions, approval of Change <br /> Order #5 in the amount of $147,113.00 for the Activity Center <br /> Construction Project, and approval to change the November 11, 1996 <br /> Regular Meeting date to November 4, 1996 due to Veteran's Day <br /> Holiday on consensus. The Council removed Items 12.C. (2) and <br /> 12.C.(5), adoption of Resolutions, to be considered separately. Mr. <br /> Guerra moveq for approval of the minutes of the Regular Meeting held <br /> September 9, 1996, approval of the two Ordinances on second reading, <br /> adoption of the remaining seven Resolutions, approval of the Change <br /> Order #5 for the Activity Center and approval of the change in <br /> Regular Meeting date from November 11 to November 4, 1996 on <br /> consensus and Mr. Mihalkanin seconded the motion, which passed <br /> unanimously.
