105 <br />Regular Meeting September-9, 1996 Page 2 <br />families are choosing to break the law to obtain marijuana when <br />conventional medicines for treatments have not been effective to <br />them or are toxic and places them at risk for criminal charges and <br />at risk for obtaining contaminated medicine because of the lack of <br />quality control and deprives patients of its therapeutic potential. <br />Ms. Ogletree urged the Council to support a resolution for Congress <br />to legalize marijuana as a medicine shown to be safe and effective. <br />Mrs. Nina Pryatel, retired registered nurse, graduated from nursing <br />school in 1935 and she worked in a hospital for the treatment of <br />cancer. At that time some surgery and mostly radium treatments were <br />used and the side effects were deep burns. Mrs. Pryatel is proud <br />nurses are coming forward regarding their responsibility to do the <br />best they can for patients and quoted from a nurses' report, <br />"Advocating legal access to marijuana for patients whose quality of <br />life can be improved through the use of this drug is a moral and <br />ethical obligation we owe the general public if we are truly serving <br />as patients' advocates." The State Nurses Organizations of <br />Colorado, Virginia and Mississippi have already passed resolutions <br />in support of this. She stated she knows there are limitations what <br />the Council can do, but she stated the Council can give support of <br />this. Dr. Ginsburg proposed a public hearing be held October 24 to <br />hear from experts on the subject. <br />Mayor Moore introduced a public hearing to consider an Annexation <br />ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 430 <br />ACRES, MORE OR LESS, INCLUDING WILLOW CREEK ESTATES, SECTION 8, <br />THE RIDGE AT WILLOW CREEK, SECTION 2, AND CERTAIN <br />UNDERDEVELOPED AREAS ALONG PURGATORY CREEK GENERALLY LOCATED <br />BETWEEN THE WESTOVER ADDITION AND WILLOW CREEK ESTATES; <br />APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING FOR <br />PUBLICATION AND DECLARING AN EFFECTIVE DATE. <br />Mayor Moore opened the public hearing and asked if anyone wished to <br />speak. Handler Smith, developer of Willow Creek Estates, asked if <br />they would be provided sewage in a reasonable length of time in this <br />area and states Police and Fire would go out of the City limits and <br />then back in to get to this area. Mr. Smith stated he is not <br />opposed to annexation but wants to know if the City will meet the <br />responsibility of providing City services. Mr. Gilley stated City <br />services will be provided with the exception of wastewater service <br />and calls for septic service permits be issued by the City and <br />street maintenance will be provided. Mr. Smith referred to Sections <br />6 and 9 meeting City standards and are not being annexed. Mr. Smith <br />felt this is selective annexation, and was advised the City's Master <br />Plan may call for annexation of these Sections but not in <br />conjunction with this particular annexation. No one else wished to <br />speak, so Mayor Moore closed the public hearing. The City Council <br />expressed interest in the City providing written notification to the <br />property owners of the area to be considered for annexation prior to <br />the second public hearing and to further discuss this process when <br />appropriate. Mr. Guerra agreed the Council needed to further <br />discuss the process and the issue for him regarding the purpose of <br />Justice Department submissions, why we are annexing and the <br />demographics of our population. Mr. Gilley stated we would notify <br />based on deed information and Mayor Moore agreed that would be <br />appropriate. <br />Mayor Moore introduced for consideration Item 4, approval of one <br />appointment to complete a vacancy on the Senior Citizens Facilities <br />Advisory Board. Ms. Hughson stated she would contact Ralph Harrel <br />to see if he is interested in serving and this will be rescheduled <br />for the next meeting. <br />Mayor Moore introduced for consideration approval of one appointment <br />to the San Marcos Electric Utility Board. Mr. Guerra moved to <br />reappoint Russell Thornton, which passed unanimously.
