108 <br />Regular Meeting September-9, 1996 Page 5 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 78.103, HOTEL OCCUPANCY TAX, OF THE <br />CITY CODE BY CHANGING THE PAYMENT DUE DATE AND INTEREST START <br />DATE; INCLUDING PROCEDURAL PROVISIONS AND PROVIDING FOR <br />PENALTIES. <br />Mr. Guerra moved for approval of the ordinance on first reading and <br />Ms. Hughson seconded the motion. Mario Gutierrez advised the <br />amendment is to bring our Code in line with State law. The Council <br />voted unanimously for approval of the ordinance on first reading. <br />Mayor Moore introduced for consideration reconsideration of a <br />Resolution, the caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, SUPPORTING LEGISLATION FOR THE CREATION OF A COMMUTER <br />RAIL DISTRICT WITHIN THE IH-35 CORRIDOR; AND DECLARING AN <br />EFFECTIVE DATE. <br />Mayor Moore stated Jim Shaw and Mr. Cox were unable to be present <br />for this meeting. Mayor Moore stated the City of Atlanta asked <br />everyone to use mass transit when at all possible during the- <br />Olympics, and it helped the flow. Mayor Moore thentmoved to table <br />the Resolution and Mr. Guerra seconded the motion. On roll call the <br />following vote was recorded: <br />AYE: Mihalkanin, Hughson, Moore, Guerra. <br />NAY: Hart, Hernandez. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, DESIGNATING CITY COUNCIL MEMBERS AS VOTING DELEGATE AND <br />ALTERNATE VOTING DELEGATE FOR THE CITY AT THE ANNUAL BUSINESS <br />MEETING OF THE NATIONAL LEAGUE OF CITIES TO BE HELD IN <br />DECEMBER, 1996; AUTHORIZING THE MAYOR TO EXECUTE ANY DOCUMENTS <br />INCIDENT TO THE DESIGNATIONS; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Guerra moved for adoption of the Resolution and to amend PART 1 <br />to name Ed Mihalkanin as the Voting Delegate and PART 2 to name Fred <br />Guerra as the Alternate Voting Delegate and Mr. Hernandez seconded <br />the motion, which passed unanimously. <br />Mayor Moore introduced for consideration approval of minutes of the <br />Regular Meeting held August 26, 1996, approval of an Ordinance on <br />second reading, adoption of ten Resolutions, and approval of motion <br />to change November 11, 1996 meeting date to November 12, 1996 due to <br />Veteran's Day holiday (see minutes of September 23 for change of <br />meeting date) on consensus. The Council removed Items 12.C.(4) and <br />12.C.(5), adoption of Resolutions, to be considered separately. Mr. <br />Guerra moved for approval of the minutes of the Regular Meeting held <br />August 26, 1996, approval of the ordinance on second reading, <br />adoption of the remaining eight Resolutions, and approval of motion <br />to change November 11, 1996 meeting date to November 12, 1996 on <br />consensus and Mr. Mihalkanin seconded the motion, which passed <br />unanimously. The captions of the Ordinance and Resolutions read as <br />follows: <br />Approval of Ordinance on second reading: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, INCREASING SEWER RATES ESTABLISHED UNDER SECTION 86.262 <br />OF THE SAN MARCOS CITY CODE; AND INCLUDING PROCEDURAL <br />PROVISIONS.
