80 <br />Regular Meeting August 26-, 1996 Page 9 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AN EXTENSION OF THE CITY'S WATER SYSTEM TO <br />SERVE A TRACT OF PROPERTY AT 1324 OLD MARTINDALE ROAD; AND <br />DECLARING AN EFFECTIVE DATE. <br />Mr. Hart moved for adoption of the Resolution and Ms. Hughson <br />seconded the motion. Mr. Hart asked how far this was from an <br />existing line, and Mr. Gilley advised fairly close because the City <br />extended a line down old Martindale Road at the request of Mrs. <br />Rich. The City paid for the line down Old Martindale Road to <br />service Mrs. Rich's property at an expense of $40,000.00. Mr. <br />Mihalkanin stated Mr. Hart had a good point about the overall policy <br />of the Council needing to be consistent. Mr. Mihalkanin agreed with <br />Mayor Moore's comment earlier in the meeting regarding if the City <br />expands services to an area, we are building in the possibility of <br />easier growth to that area. He stated there seems to be a lot <br />involved in the decision made and wonders if everyone was thinking <br />of the implications. Ms. Hughson asked for clarification on the <br />location of this property and Mr. Boeker advised her it was before <br />Green Valley Farms. The Council voted unanimously for adoption of <br />the Resolution. Ms. Hughson stated the need to have a consistent <br />policy on extensions, and Mayor Moore requested Mr. Gilley prepare a <br />presentation for the Council regarding in City/out of City rates, <br />approaches we take and cost and benefit of extension. Mr. Gilley <br />stated we have policies in place now dealing with this issue, <br />including Development ordinances dealing with utility extensions, a <br />utility extension policy to areas currently not being served, and <br />the exceptions to these policies. There have been several <br />exceptions to these policies made by the Council because Council <br />heard presentations where it made sense to Council to extend <br />utilities in such a way it did not follow standard policies and <br />practices, and agreed to extend. That is what is at issue here with <br />regard to being consistent. Mr. Gilley will prepare a presentation <br />for the Council. <br />Mayor Moore introduced for consideration Item 10.B.(6) removed from, <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AMENDMENT NUMBER 4 TO THE SOLID WASTE <br />COLLECTION AGREEMENT WITH BROWNING-FERRIS, INC. TO PROVIDE FOR <br />A PILOT PROGRAM FOR ONCE-PER-WEEK LARGE CONTAINER SOLID WASTE <br />COLLECTION IN AN AREA OF THE CITY; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE AMENDMENT; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Guerra stated he is an employee of BFI and would not participate <br />in this matter because he has a conflict of interest, filed an <br />affidavit and left the Chambers. Mr. Hart moved for adoption of the <br />Resolution and Mr. Hernandez seconded the motion. Mayor Moore <br />stated this will be on San Antonio and MLK. Ms. Hughson asked if <br />the information flyers were delivered to all residents and Mr. <br />Clement stated that had been done. Copies were made for the Council <br />in the meeting. Ms. Hughson stated earlier information indicated <br />there would be smaller carts made available for those who did not <br />wish to have the large one, and she wanted to know if they would be <br />available during the interim period. Mr. Clement stated <br />availability of a smaller cart is not included on the flyer. He <br />stated if the reason someone does not want to have the large cart is <br />because they are unable to navigate it, they will make special <br />arrangements for them to have smaller carts. Those wishing to use a <br />smaller cart for this reason would have to make their request <br />through the City, and BFI will do this. Mr. Clement stated one <br />situation involved intersections wherein two customers that set <br />their wastes out on Mitchell rather than San Antonio and were. <br />concerned whether or not BFI would pick it up. They have agreed to <br />do that at all intersections in the pilot area. Ms. Hughson stated <br />the calls and correspondence she has received regarding this matter <br />is in opposition to the use of the 95 gallon cart. Ms. Hughson <br />stated she was concerned that if a survey is done at the conclusion <br />of the pilot program, people may have been pleased with the program <br />if they had had the smaller cart.
