<br />44 <br /> <br /> <br />Regular Meeting August 1~, 1996 Page 10 <br /> <br /> <br />formulating a vision¡ and he thought this was already accomplished. <br />Mr. Mihalkanin stated it was worded in such a manner to allow any <br />changes that are recommended to be in line with the previous work <br />done by Mr. Kimmel's group, and with this larger group, to make sure <br />there is some kind of clarity in what people are interested in. Mr. <br />Cox stated the group will come out with specific objectives and how <br />to get there, and Mr. Mihalkanin stated that is more connected to <br />the tasks listed. It was consensus of Council to have Lydia Marie <br />Trevino and Phil Neighbors as Resource people and name another i <br />representative from the Hispanic Chamber of Commerce to serve on the' <br />Membership Committee. It was consensus of Council the purpose and <br />tasks for the Committee look good. (5) Mr. Mihalkanin stated he <br />did not think the Council had made a determination whether or not <br />the members of the new CVB Board will reside in the City or not. It <br />was consensus ,for as many as five to reside outside the City limits <br />and ten would reside in the City limits. Mr. Guerra stated he had <br />recommended some resource people but pointed out this was not <br />intended to preclude the Council from designating other ex-officio <br />members as resource people. The Council directed the appointments <br />be scheduled the first meeting in September following the approval <br />of the contract. The Council drew lots to determine which <br />appointments they would make, as follows (one of each): Mayor Moore <br />two Council Members, and Arts Community; Ms. Hughsoh - Arts <br />Community and Hotel Industry; Mr. Hart - Hospitality Association and <br />Greater San Marcos Area Council of Neighborhood Associations; Mr. <br />Cox - Hospitality Association and Heritage Association; Mr. <br />Hernandez - Hospitality Association and Chamber of Commerce; Mr. <br />Mihalkanin - Hotel Industry and Downtown Association; Mr. Guerra - <br />Hotel Industry and Hispanic Chamber. (6) Mr. Mihalkanin stated <br />there was a question at the last meeting regarding voting. Mr. <br />Mihalkanin called the Legislative Counsel in Austin which provides <br />information on parliamentary procedure to the Texas State <br />Legislature and spoke with Steve Collins. Mr. Collins advised most <br />State Legislators use a designation of "present" when not voting in <br />those issues where they do not think they can vote yes or no. He <br />stated although "abstaining" is in the Roberts Rules of Order, Mr. <br />Collins did not think there was a distinction between them, present <br />is the equivalent of abstain. Mr. Hart stated he appreciated the <br />benefit of that information, but he still thinks the citizens are <br />entitled to know how each Council Member stands on issues. Mr. <br />Hart's personal opinion is the Council is there to cast votes unless <br />a Council Member is in a situation where he/she has not had the <br />opportunity to discuss the matter or review the material provided. <br /> <br />Mayor Moore introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to discuss pending litigation <br />(Sierra Club vs. San Antonio; Kencon Constructors vs. City of San <br />Marcos) and matters where the City Attorney's ethical duty to the <br />City clearly conflicts with Government Code Chapter 551 (Centerpoint <br />Road area development incentives; sale of surplus property; McCarty <br />Ranch Subdivision; and acquisition of Elim Water Company). Mr. <br />Hernandez moved the Council adjourn into Executive Session at 10:56 <br />p.m. and Ms. Hughson seconded the motion, which passed unanimously. <br /> <br />Ms. Hughson moved the Council reconvene at 12:38 a.m. and Mr. <br />Mihalkanin seconded the motion, which passed unanimously (Mayor ¡- <br />Moore not present for this vote). ¡ <br />¡ <br /> <br />The meeting adjourned at 12:44 a.m. on motion made by Mr. Hernandez' <br />and seconded by Ms. Hughson. <br /> <br />D~~~ <br /> <br />- Billy G.
