<br />39 <br /> <br /> <br />Regular Meeting August 12, 1996 Page 5 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96 <br />FISCAL YEAR TO PROVIDE FUNDS FOR THE RECONSTRUCTION OF <br />PATRICIA, OAKDALE AND HAYS STREETS IN CONNECTION WITH THE <br />SUNSET ACRES UTILITY SYSTEMS IMPROVEMENT PROJECT; AND DECLARING <br />AN EMERGENCY. <br /> <br />Mr. Cox moved for adoption of the Ordinance on emergency'and Mr. <br />Guerra seconded the motion, which passed unanimously. <br /> <br />Mayor Moore introduced for consideration adoption of an Ordinance on <br />emergency I the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS I AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96 <br />FISCAL YEAR TO PROVIDE FUNDS FOR STREET MILLING FOR THE SUNSET <br />ACRES UTILITY SYSTEMS IMPROVEMENT PROJECT; AND DECLARING AN <br />EMERGENCY. <br /> <br />Mr. Hernandez moved for adoption of the Ordinance on emergency and <br />Mr. Mihalkanin seconded the motion. Laurie Anderson advised the <br />Council asphalt milling is a process that chews up the existing <br />asphalt and blends it with the base. As an example, she stated this <br />is the process that was recently done on Riverside. The Council <br />voted unanimously for adoption of the Ordinance. . <br /> <br />Mayor Moore introduced for consideration approval of minutes of..the <br />Regular Meeting held July 221 1996 and Special Meeting held August <br />5, 19961 adoption of an Ordinance on third and final readingl <br />adoption of nine Resolutionsl approval of funds from the Tourist <br />Account (1) in the amount of $1,200.00 in paYment of booth space for <br />the NLC Conference to be held in San Antonio in Decemberl 1996 and <br />(2) in the amount of $5/100.00 for weepuls and cups to be used to <br />. promote tourism to San Marcos, approval for use of General Fund <br />I contingency funds in the amount of $37/000.00 for outside counsel <br />and expert witness fees in connection with a Construction Contract <br />lawsuit brought by Kencon Constructors regarding the Public Library <br />Project, and approval of Change Order No.2 in the amount of <br />$210,374.15 to add reconstruction of a portion of Patricia Street, <br />Oakdale and Hays Streets in connection with the Sunset Acres <br />Utility Systems Improvement Project on consensus. The Council <br />removed Items 9.C. (2) I 9.C. (5), 9.C. (6), 9.C. (7), 9.C. (8) I adoption <br />of Resolutions, and 9.E., approval for use of' GF contingency funds <br />in the amount of $37,000.00 in connection with the Kencon' <br />litigation, to be considered separately. Mr. Guerra moved for <br />approval of the minutes of the Regular Meeting held July 22, 1996 <br />and Special Meeting held August 51 1996, adoption of the Ordinance <br />on third and final reading, adoption of the four remaining <br />Resolutions I approval of funds from the Tourist Account in the <br />amounts of $1,200.00 for booth space at NLC and $5,100.00 for <br />weepuls and cups to promote tourism, and approval of Change Order <br />No.2 in the amount of $210,374.15 to add reconstruction of <br />Patricia, Oakdale and Hays Streets in connection with the Sunset <br />Acres Utility Systems Improvement Project on consensus and Mr. Hart <br />seconded the motionl which passed unanimously.
