39 Regular Meeting August 12, 1996 Page 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96 FISCAL YEAR TO PROVIDE FUNDS FOR THE RECONSTRUCTION OF PATRICIA, OAKDALE AND HAYS STREETS IN CONNECTION WITH THE SUNSET ACRES UTILITY SYSTEMS IMPROVEMENT PROJECT; AND DECLARING AN EMERGENCY. Mr. Cox moved for adoption of the Ordinance on emergency'and Mr. Guerra seconded the motion, which passed unanimously. Mayor Moore introduced for consideration adoption of an Ordinance on emergency I the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS I AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96 FISCAL YEAR TO PROVIDE FUNDS FOR STREET MILLING FOR THE SUNSET ACRES UTILITY SYSTEMS IMPROVEMENT PROJECT; AND DECLARING AN EMERGENCY. Mr. Hernandez moved for adoption of the Ordinance on emergency and Mr. Mihalkanin seconded the motion. Laurie Anderson advised the Council asphalt milling is a process that chews up the existing asphalt and blends it with the base. As an example, she stated this is the process that was recently done on Riverside. The Council voted unanimously for adoption of the Ordinance. . Mayor Moore introduced for consideration approval of minutes of..the Regular Meeting held July 221 1996 and Special Meeting held August 5, 19961 adoption of an Ordinance on third and final readingl adoption of nine Resolutionsl approval of funds from the Tourist Account (1) in the amount of $1,200.00 in paYment of booth space for the NLC Conference to be held in San Antonio in Decemberl 1996 and (2) in the amount of $5/100.00 for weepuls and cups to be used to . promote tourism to San Marcos, approval for use of General Fund I contingency funds in the amount of $37/000.00 for outside counsel and expert witness fees in connection with a Construction Contract lawsuit brought by Kencon Constructors regarding the Public Library Project, and approval of Change Order No.2 in the amount of $210,374.15 to add reconstruction of a portion of Patricia Street, Oakdale and Hays Streets in connection with the Sunset Acres Utility Systems Improvement Project on consensus. The Council removed Items 9.C. (2) I 9.C. (5), 9.C. (6), 9.C. (7), 9.C. (8) I adoption of Resolutions, and 9.E., approval for use of' GF contingency funds in the amount of $37,000.00 in connection with the Kencon' litigation, to be considered separately. Mr. Guerra moved for approval of the minutes of the Regular Meeting held July 22, 1996 and Special Meeting held August 51 1996, adoption of the Ordinance on third and final reading, adoption of the four remaining Resolutions I approval of funds from the Tourist Account in the amounts of $1,200.00 for booth space at NLC and $5,100.00 for weepuls and cups to promote tourism, and approval of Change Order No.2 in the amount of $210,374.15 to add reconstruction of Patricia, Oakdale and Hays Streets in connection with the Sunset Acres Utility Systems Improvement Project on consensus and Mr. Hart seconded the motionl which passed unanimously. Adoption of Resolutions: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE SUBMISSION OF APPLICATIONS FOR REIMBURSEMENT OF REMEDIATION COSTS INCURRED BY THE CITY ON LPST #92680 DURING THE FIRST AND SECOND QUARTERS OF CALENDAR YEAR 1996, TO THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION; AND DECLARING AN EFFECTIVE DATE.
