80 <br />Regular Meeting April 22T 1996 Page 6 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING FINAL PAYMENT TO OLIVER ROOFING SYSTEMS FOR <br />THE COMPLETION OF THE CITY OF SAN MARCOS ROOF REPAIR PROJECT; <br />ACCEPTING THE PROJECT FOR USE BY THE CITY; AUTHORIZING FINAL <br />PAYMENT IN THE AMOUNT OF $8,560.90; AND DECLARING AN EFFECTIVE <br />DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, RATIFYING THE SUBMISSION OF AN APPLICATION TO THE TEXAS <br />PARKS AND WILDLIFE DEPARTMENT FOR A GRANT FOR FUNDS TO DEVELOP <br />A NATURE TRAIL SYSTEM AND EDUCATIONAL PROGRAM ON THE SAN MARCOS <br />RIVER; AUTHORIZING THE CITY MANAGER TO ACT IN ALL MATTERS <br />REGARDING THIS TEXAS PARKS AND WILDLIFE DEPARTMENT GRANT <br />PROGRAM; AND DECLARING AN EFFECTIVE DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE <br />TEXAS DEPARTMENT OF TRANSPORTATION FOR A GRANT FOR THE <br />CITY-WIDE INTERMODAL TRANSPORTATION SYSTEM PROJECT UNDER THE <br />1996 STATEWIDE TRANSPORTATION ENHANCEMENT PROGRAM; AUTHORIZING <br />THE CITY MANAGER TO ACT IN ALL MATTERS REGARDING THIS GRANT <br />PROJECT; AND DECLARING AN EFFECTIVE DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE PURCHASE OF VALVES AND INSTALLATION <br />SERVICES FROM MINEOLA VALVE AND HYDRANT COMPANY AS A SOLE <br />SOURCE PROCUREMENT; RATIFYING THE PURCHASING MANAGER'S ISSUANCE <br />OF PURCHASE ORDERS; AND DECLARING AN EFFECTIVE DATE. <br />Mayor Morris introduced for consideration Item 10.D.(3) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL <br />TEXAS, APPROVING THE PURCHASE OF <br />THE PUBLIC WORKS DEPARTMENT FROM <br />INC.; AUTHORIZING THE PURCHASING <br />APPROPRIATE PURCHASING DOCUMENTS <br />DECLARING AN EFFECTIVE DATE. <br />OF THE CITY OF SAN MARCOS, <br />A MULTIPURPOSE EXCAVATOR FOR <br />WAUKESHA-PEARCE INDUSTRIES, <br />MANAGER TO EXECUTE THE <br />ON BEHALF OF THE CITY; AND <br />Mr. Moore moved for adoption of the Resolution and Mr. Mooney <br />seconded the motion. David Stange of Waukesha-Pearce requested the <br />City rebid the purchase, as they made a clerical error in bidding. <br />They are a single source and would appreciate the City rebidding so <br />they can submit a competitive bid, and their error was not <br />discovered until bid opening. Mr. Taylor advised the Council the <br />bidder cannot withdraw his bid after bid opening, but the Council <br />can reject the bid. If the Council chooses to award the bid, it is <br />a binding contract. Mr. Cox stated the City does business on an <br />equitable basis. Mr. Moore withdrew his motion to adopt the <br />Resolution and Mr. Mooney withdrew his second. Mr. Cox then moved <br />to reject the bid and Mr. Moore seconded the motion. On roll call <br />the following vote was recorded: <br />AYE: Moore, Cox. <br />NAY: Mooney, Hart, Morris, Guerra, Hernandez. <br />ABSTAIN: None. <br />The motion failed. Mr. Guerra then moved for adoption of the <br />Resolution and Mr. Hernandez seconded the motion, which passed <br />unanimously. <br />Mayor Morris introduced for consideration Item 10.D.(6) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING A LICENSE AGREEMENT WITH THE CITY OF AUSTIN <br />FOR THE USE OF AIRPORT PROPERTY TO CONDUCT AIR QUALITY TESTS; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE LICENSE AGREEMENT; <br />AND DECLARING AN EFFECTIVE DATE.
