Mr. Guerra asked why the amount of $10 was <br />used in the agreement, and Mr. Taylor advised this is a nominal <br />amount used in contracts. The Council voted unanimously for <br />adoption of the Resolution. <br />Mayor Morris introduced for consideration Item 10.D.(9) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AN AGREEMENT FOR KXAN TELEVISION TO MAINTAIN <br />TWO ANTENNAS ON A CITY WATER TOWER LOCATED ON ALAMO STREET; <br />AUTHORIZING THE CITY MANAGER TO SIGN THE AGREEMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br />Mr. Guerra moved for adoption of the Resolution and Mr. Moore <br />seconded the motion. Mr. Guerra asked how the amount of the <br />agreement of $364.00 was determined. Mr. Gilley advised it was a <br />negotiated price determined to be a fair market value. Mr. Taylor <br />advised there is an escalation clause built into the agreement. Mr. <br />Guerra moved to amend the Resolution in Section 6 of the Agreement <br />to change the amount to $500.00. There was no second on the <br />amendment, and the motion failed. The Council then voted <br />unanimously for adoption of the Resolution. <br />Mayor Morris introduced for consideration Item 10.D.(10) removed <br />from the consensus agenda, adoption of a Resolution, the caption <br />which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF SAN MARCOS, TEXAS, <br />APPROVING THE ASSIGNMENT OF THE COMPUTER SOFTWARE MAINTENANCE <br />AND LICENSE AGREEMENTS BETWEEN THE CITY AND EGRET HOLDINGS, <br />INC. TO SONATA SYSTEMS, INC.; APPROVING AN AMENDMENT TO THE <br />SOFTWARE MAINTENANCE AGREEMENT; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE AN ACCEPTANCE OF THE ASSIGNMENT AND THE CONTRACT <br />AMENDMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br />Mr. Moore moved to table the Resolution and Mayor Morris seconded <br />the motion, which passed unanimously. <br />Mayor Morris introduced for consideration Item 10.D.(13) removed <br />from the consensus agenda, adoption of a Resolution, the caption <br />which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL <br />AGREEMENT BETWEEN THE CITY AND THE GUADALUPE-BLANCO RIVER <br />AUTHORITY FOR THE DEVELOPMENT OF A REGIONAL SURFACE WATER <br />PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT <br />ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Cox moved for adoption of the Resolution and Mr. Guerra seconded <br />the motion. Mayor Morris stated she was pleased an agreement had <br />been reached. She stated although an off-channel reservoir is not <br />popular, she thinks the City needs to plan for it now. Mayor Morris <br />expressed concern GBRA will operate facilities when the City is well <br />represented in a participatory and financial way. Mr. Gilley stated <br />the operating agreements will come later. Mr. Hart stated at what <br />juncture will all stages of the contracts be negotiated, and Mr. <br />Gilley stated the philosophical agreement is being put in place <br />tonight. Mr. Guerra wanted to know who would be able to tap into <br />the City's raw water. Mr. Gilley stated those kinds of issues need <br />to be addressed and decisions made as to who, if any, can tap into <br />our raw water. Mr. Guerra stated if we allow anyone to tap, we need <br />to allow all to tap equally for the same charge. Mr. Moore asked <br />about right-of-way along IH35, and Mr. Gilley stated if we lay lines <br />along IH35, we would have to move them when the highway expands in <br />the future. Mr. Cox asked if additional surface water from Canyon <br />would be available to us and if we could acquire more when needed. <br />Mr. Bill West of GBRA advised Canyon has water available for
