77 <br />Regular Meeting February 26, 1996 Page 2 <br />Mayor Morris opened the public hearing and asked if anyone wished to speak. No one wished to <br />speak, so Mayor Morris closed the public hearing. Mr. Taylor received a letter from Michael <br />Beaty stating there would be measures taken in the activity center project to minimize harm to the <br />land. The letter stated the existing site is low-lying, essentially flat and very little existing <br />vegetation except for native grasses and a small number of trees. Mayor Morris read the <br />measures into the record. Mr. Moore moved for adoption of the Resolution and Mr. Cox <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAT MARCOS, <br />TEXAS, AMENDING THE ORDINANCE ADOPTED ON FEBRUARY 12, 1996 <br />ORDERING A JOINT GENERAL AND SPECIAL ELECTION BY THE CITY AND <br />THE SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT TO <br />ADD A TEMPORARY BRANCH EARLY POLLING PLACE; AND DECLARING AN <br />EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. Mooney seconded the <br />motion, which passed unanimously. i <br />Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1995-96 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE PARKER DRIVE WATER AND <br />WASTEWATER EXTENSIONS AND DECLARING AN EMERGENCY. <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. Hernandez seconded the <br />motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 98.031 OF THE SAN MARCOS CITY CODE TO <br />ADOPT A NEW PRELIMINARY FLOOD INSURANCE RATE STUDY ISSUED BY <br />THE FEDERAL EMERGENCY MANAGEMENT AGENCY; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mr. Moore moved for approval of the Ordinance on first reading and Mr. Mooney seconded the <br />motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption <br />which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, EXTENDING THE HOURS FOR THE ON-PREMISE SALE OF MIXED <br />BEVERAGES AND BEER IN THE CITY FOR A TRIAL PERIOD UNTIL JULY 31, <br />1996; INCLUDING PROCEDURAL PROVISIONS AND PROVIDING FOR <br />PENALTIES. <br />Mr. Guerra moved for approval of the Ordinance on first reading and Mr. Moore seconded the <br />motion. Mr. Guerra asked if the SUP for fraternities would still exist. Mr. Patterson stated the <br />SUP were still enforceable under their same terms. Mr. Hernandez questioned the current <br />litigation in Comal County and if this Ordinance would also subject San Marcos to the same type <br />litigation. Mr. Taylor stated this Ordinance had a firm standing the bar hours would <br />strictly be a trial period with authority to rescind at the end of the period. Mr. Taylor also stated
