funds to make such payments during the City's fiscal year in which such Grant Payment(s) or <br />other payments are payable under this Agreement. <br />Section 6.03. No City Liability for Operation Expenses. Grifols acknowledges that <br />the City is not committed or obligated to pay any expenditure incurred with respect to the <br />operation of the Business or the Project, and is only obligated to make Grant Payments as set <br />forth in this Agreement. <br />Section 6.04. No Recourse. Grifols shall have no recourse against the City for failing to <br />budget and appropriate funds during any fiscal year to meet the purposes and obligations under <br />this Agreement. <br />ARTICLE VII <br />INFORMATION <br />Section 7.01. Information. Grifols shall, at such times and in such form as City may <br />reasonably request from Grifols, provide information concerning the performance of Grifols' <br />obligations under this Agreement. <br />Section 7.02. Annual Reports Related To Construction, Jobs, And Compliance <br />With Agreement. No later than January 30 of each year during the Term, the Grifols shall <br />submit to the City a certified statement in the form attached as Exhibit "D", signed by an <br />authorized officer or employee of Grifols, providing the following information: <br />a. the total number of square feet of and value of New Improvements <br />constructed in the prior year and cumulatively since the Effective Date; <br />b. a description and the value of all Personal Property added in the prior year <br />and cumulatively since the Effective Date and the Personal Property Taxes attributable <br />thereto; <br />C. the total number of Jobs filled in the prior year and cumulatively since the <br />Page 10 of 22
