the speed limits along a section of S.H. 123 in both directions from a point south of • <br />Monterev Oaks to the San Marcos south city limits; providing a savings clause; providing <br />that all conflicting ordinances are repealed; and providing an effective date. <br />11. Consider adoption of Resolution 2009-91R, approving an advance funding agreement <br />for a Surface Transportation Program-Metropolitan Mobility Project between the City and <br />the State of Texas acting through the Texas Department of Transportation for the City's <br />construction of sidewalks on North LBJ Drive from Hopkins Street to University Drive; <br />approving the City's estimated contribution of $41,750 in overmatch participation in the <br />project; authorizing the City Manager to execute this agreement on behalf of the City; and <br />declaring an effective date. <br />12. Consider adoption of Resolution 2009-92R, awarding an annual contract to Interstate <br />Electric for the provision of pump and motor repair for the Water/Wastewater Division of <br />the Public Works Department in the estimated total amount of $70,000, authorizing the <br />City Manager to execute the appropriate contract documents on behalf of the City; and <br />declaring an effective date. <br />13. Consider adoption of Resolution 2009-93R, awarding a construction contract to Smith <br />Contracting Company, Inc. for the River Road Water Line Proiect in the amount of <br />$310,901 contingent upon the bidder's timely submission of sufficient bonds and insurance <br />in accordance with the City's bid documents for the project; authorizing the City Manager <br />to execute the contract documents on behalf of the City and declaring an effective date. • <br />14. Consider adoption of Resolution 2009-94R, awarding a construction contract to Benitez <br />Construction, Inc. for the Waco Street Sanitarv Sewer Improvements Proiect in the <br />amount of $48,750.75 contingent upon the bidder's timely submission of sufficient bonds <br />and insurance in accordance with the City's bid documents for the project; authorizing the <br />City Manager to execute the contract documents on behalf of the City and declaring an <br />effective date. <br />15. Consider adoption of Resolution 2009-95R, ratifying the submission of a Neighborhood <br />Stabilization Grant to the Texas Department of Housing and Community Affairs, <br />authorizing the City Manager to execute the grant agreement; and declaring an effective <br />date. <br />16. Consider adoption of Resolution 2009-96R, supporting the designation of a segment of <br />the San Marcos River extending from IH 35 to its headwaters as a stream segment having <br />unique ecological value under section 16.051(f) of the Texas Water Code; and declaring an <br />effective date. <br />17. Consider a motion to offer an economic development incentive under Chapter 380 of <br />the Texas Local Government Code to Grifols, Inc. in the form of refunds of 75% of <br />personal property taxes paid annually over a term of 15 years for an estimated total of <br />$1,829,190 in exchange for the location of a biomedical facility employing 190 full-time • <br />employees with an estimated average annual wage of $38,571 in the City of San Marcos and <br />RM072109 Minutes Page 4
