16 Regular Meeting January 22, 1996 Page 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS¡ AMENDING THE FUTURE LAND USE MAP OF THE MASTER PLAN OF THE CITY, FROM MEDIUM DENSITY RESIDENTIAL TO COMMERCIAL FOR A 0.75 ACRE TRACT OF PROPERTY LOCATED AT THE CORNER OF ELLIS STREET AND IH-35 SOUTH¡ AND DECLARING AN EFFECTIVE DATE. Mayor Morris opened the public hearing and asked if anyone wished to i speak. No one did, so Mayor Morris closed the public hearing. Mr. Hernandez moved for adoption of the Resolution and Mr. Cox seconded the motion. Mr. Patterson advised Mr. Guerra this would be for mobile homes. On roll call the following vote was recorded: AYE: Mooney, Hart, Morris, Cox, Hernandez. NAY: Guerra. ABSTAIN: None. (Mr. Moore not present to vote on this item). Mayor Morris introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.25 ACRE TRACT OF PROPERTY LOCATED AT 201 ELLIS STREET, FROM "I" (INDUSTRIAL DISTRICT) TO "C" (COMMERCIAL DISTRICT) ¡ INCLUDING PROCEDURAL PROVISIONS¡ AND PROVIDING FOR PENALTIES. Mayor Morris opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Morris closed the public hearing. Mr. : Cox moved for adoption of the Zoning Ordinance and Mr. Moore seconded the motion. On roll call the following vote was recorded: AYE: Moore, Mooney, Hart, Morris, Cox, Hernandez. NAY: Guerra. Mayor Morris introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.41 ACRE TRACT OF PROPERTY LOCATED AT THE CORNER OF ALLEN AND DELMAR STREETS, FROM "TH-1" (TOWNHOUSE RESIDENTIAL DISTRICT [LOW DENSITY) TO "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) ¡ INCLUDING PROCEDURAL PROVISIONS AND PROVIDING FOR PENALTIES. Mayor Morris opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Morris closed the public hearing. Mr. Hernandez moved for adoption of the Zoning Ordinance and Mr. Moore seconded the motion. Mr. Cox asked Mr. Patterson if there is an obligation for street work, and Mr. Patterson advised a plat will come before the Planning and Zoning Commission and then to the Council with possible options how best to develop these areas. The Council voted unanimously for adoption of the Zoning Ordinance. Mayor Morris introduced for consideration a public hearing and adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE AFFECTING PARTICIPATION OF CITY EMPLOYEES IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM, GRANTING THE ADDITIONAL RIGHTS AUTHORIZED BY SECTION 854.202(g) OF TITLE 8, TEXAS GOVERNMENT CODE, AS AMENDED¡ GRANTING TO CITY EMPLOYEES ADDITIONAL RIGHTS AND CREDITS IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM AS AUTHORIZED BY SECTION 853.303, TITLE 8 OF THE
