SECTION12:PUBLICSERVICECAP <br />TheCityofSanMarcoshasnotincorporatedaPublicServicecomponentintotheCDGBDRActionPlan. <br />However,anyPlanamendmentwillcomplywith24CFR570.201andallocatenomorethan$3,762,000 <br />or15%ofthetotalamountofthe$25,080,000ofCDBGDRfundsawardedforPublicServices. <br />SECTION13:PREVENTINGFRAUD,ABUSEOFFUNDSANDDUPLICATIONOFBENEFITS <br />Inordertoensuretheproperdisbursementofgrantfunds,theCityofSanMarcosplanstoremainin <br />compliancewithapplicableCDBGrulesandregulations,aswellasotherapplicablefederalregulations <br />includingOfficeofManagementandBudget(OMBSuperCircular)2CFR200UniformAdministrative <br />Requirements.TheCityofSanMarcoswillparticularlyemphasizemitigationoffraud,abuseand <br />mismanagementrelatedtoaccounting,procurementandaccountabilitywhichmayalsobeinvestigated. <br />Inadditiontothestepslistedbelow,Section15MonitoringandSection18Audits ofthisdocumentalso <br />detailthe/źƷǤ͸ƭpl a ntopreventfraud,abuseoffundsandduplicationofbenefits. <br />A.DuplicationofBenefits <br />CDBGDRfundsmaybeusedtoprovideassistancetotheextentthatadisasterrecoveryneedhasnot <br />beenmetbyothersources.Applicantsforassistancewillberequiredtodiscloseallsourcesofassistance <br />appliedfor,receivedortobereceived.Allapplicantswillsigndocumentscertifyingallsourcesof <br />assistanceweredisclosed.TheapplicantwillalsocertifytheirunderstandingthatrepaymentoftheCDBG <br />DRassistancewillberequiredifadditionalfundingismadeavailabletothemduringthetermofthe <br />contractorafterthecontractexpires. <br />DuplicationofBenefits(DOB)isstrictlyprohibited.Ingeneral,Section312oftheRobertT.Stafford <br />DisasterAssistanceandEmergencyReliefAct(42U.S.C.5155),asamended,prohibitsanyperson,business <br />concern,orotherentityfromreceivingfinancialassistancewithrespecttoanypartofalossresultingfrom <br />amajordisasterastowhichhe/shehasreceivedfinancialassistanceunderanyotherprogramorfrom <br />insuranceoranyothersource. <br />Inordertocomplywiththislaw,casemanagerswillapplyallDOBpoliciespriortodeterminingthelevel <br />ofassistanceapplicantsmaybeeligibletoreceive.TheCitywillrequirethateachactivityprovide <br />assistancetoapersonorentityonlytotheextentthatthepersonorentityhasadisasterrecoveryneed <br />thathasnotbeenmet. <br />TheCitywillcontinuouslymonitorprogramapplicantsforcompliancewithCDBGDRandDOB <br />requirements.Itisconceivablethatallfundingsourcesmaynotbeknownatthetimeofdetermining <br />eligibility.Therefore,theCitywillcontinuetodoitsduediligencetoverifybenefitsthatmayhavebeen <br />securedfromFEMA,SBA,privateinsurers,charitablecontributions,andanyotheravailablefinancial <br />assistance.Thisinformationwillbeassessedandweighedagainsttheirunmetneedspriortothe <br />ğƦƦƌźĭğƓƷ͸ƭapprovalforCDBGDRprogramfundsaswellasthroughoutthedurationoftheğƦƦƌźĭğƓƷ͸ƭ <br />agreementwiththeCity. <br />Aspartofthecasemanagementprocess,theCitywillrequireapplicantstoexecuteanIncome <br />Certification,InsuranceCertification,andSubrogationAgreement,whichwillbecomepartofeach <br />ğƦƦƌźĭğƓƷ͸ƭrecord.Thesedocumentswillholdeachapplicantaccountabletotheaccuracyofinformation <br />providedandalsogivetheCityrecourseifitisdeterminedatalatertimethatapplicantsreceivedother <br />financialassistancethatwasnotidentifiedatthetimeofapplication.Ifaduplicationofbenefitsarisesin <br />thedurationoftheagreement,theCitywilladheretotheguidelinessetforthintheCDBGDR <br />CITYOFSANMARCOSCDBGDRFINANCIALPOLICIES&PROCEDURESMANAUAL22|P <br />AGE <br /> <br />
