TheCommunityInitiativesDivisionstafforconsultantswillmonitorcompliancewithvariouscrosscutting <br />regulationsincluding,butnotlimitedto: <br />DavisBaconandRelatedActs <br />Section3 <br />LeadPaint <br />FairHousing <br />AcquisitionandrelocationrequirementsoftheURA <br />FloodPlainInsurance <br />E.LongTermCompliance <br />Forhousingprojectshavinglongtermcompliancerequirements,theCitywillmonitorannuallytoensure <br />compliancewithfundingterms.TheCitywillrequireunitinspectionsandtenantrentandincome <br />certificationsofFederallyassistedpropertieseveryyear.AnyrentalunitssubsidizedwithCDBGDRfunds <br />mustberecertifiedtodeterminethattherentand/orincomeremainsincompliancewiththeHUDrent <br />and/orincomelimitsfortheprojectandthattheunitsareoccupiedbyincomeeligibletenants.In <br />addition,everyFederallyassistedunitwillbeinspectedtodeterminecompliancewithI <br />5͸ƭHousing <br />QualityStandards. <br />SECTION16:TIMELINESSOFEXPENDITURES <br />TheCityofSanMarcoswillutilizethereimbursementmethodforrequestingdrawdownofCDBGDR <br />fundsinaccordancewith2CFR200.305.TheCitywillutilizeregularmonitoringandreportingofboth <br />Citymanagedprogramsandsubrecipients,toensurethattimelinessstandardsaremet. <br />TheCDBGDRActionPlaninDRGRwillprovidequarterlyspendingestimatesandcompletiontargetsfor <br />eachproject.ThiswillincludeCitymanaged,aswellas,anysubrecipientprojects.TheHousingand <br />CommunityDevelopmentManagerwilltrackexpenditureandcompletiontargetsonamonthlybasis <br />usingthe/źƷǤ͸ƭMunissystem.AtthetimeofeachquarterlyreportinDRGR,theFinanceDepartmentwill <br />comparetheactualexpendituresandcompletionratesagainsttheprojectedexpendituresand <br />completionrateswithinDRGR.AnydiscrepancieswillbereportedtotheappropriateProgramManager <br />forresolution.Resolutionmaybeaccomplishedthroughthecreationofaplantoreturntotheanticipated <br />scheduleorrevisethescheduleasnecessary.AdjustmentsandrevisionswillbeapprovedbytheProgram <br />Manager,andwhenrequired,arequestwillbemadetoHUDforapprovalpriortoenteringthechanges <br />intoDRGR. <br />SECTION17:SUBRECIPIENTREQUIREMENTS <br />SubrecipientsarerequiredbytheCityofSanMarcostofollowallapplicablelaws,standardsand <br />regulationsrelatedtotheHUDCDBGDRProgramaswellasallotherState,LocalandFederallaws.Each <br />subrecipientwillexecuteaSubrecipientAgreementwhichdetailscompliancefactorswhichmustbe <br />satisfiedaswellasestablishingaprojectbudget,timeline,andspecificgoalsandobjectives.TheCDBG <br />Subrecipienttemplateisincludedinthe Appendix. <br />SubrecipientmonitoringiscoveredinSection15above. <br />AnydeficienciesnotedinauditreportsmustbefullyclearedbytheSubrecipientwithin30daysafter <br />receiptbytheSubrecipient.FailureoftheSubrecipienttocomplywiththeaboverequirementswill <br />constituteaviolationofthiscontractandmayresultinthewithholdingoffuturepayments. <br />CITYOFSANMARCOSCDBGDRFINANCIALPOLICIES&PROCEDURESMANAUAL27|P <br />AGE <br /> <br />
