City Council Meeting Minutes February 21, 2017 <br />Against: 0 <br />Absent: 1 - Council Member Derrick <br />22. Receive an update on Senate Bill 71 (SB 71) which, if passed would authorize the <br />State of Texas to convey ownership of the bed and banks of the San Marcos River <br />within the corporate limits of the City to City of San Marcos, and provide direction to <br />Staff. <br />Kristi Wyatt, Director of Communications and Intergovernmental Relations, <br />provided the Council with an update regarding Senate Bill 71. The following <br />suggested edits were provided by Deputy Mayor Pro Tem Prewitt: <br />Section 2. <br />(2) sells, creates easements or leases all or any part of the property; <br />(3) creates additional access points to the river from property that is <br />wholly or partly owned, leased or managed by any entity other than the <br />City of San Marcos; <br />(4) covers any part of the river bank with impermeable cover for any <br />purpose other than erosion control; or <br />(5) does not adhere to best management practices set forth in State, <br />Federal and local regulations and ordinances, including but not limited <br />to Texas Parks and Wildlife, Texas Commission on Environmental Quality, <br />US Fish and Wildlife Service, US Environmental Protection Agency and <br />local water quality protections efforts (e.g. water quality buffers, <br />riparian zones. <br />(b) For the purposes of this statute, `public purpose' does not include <br />economic development. <br />Staff and Senator Zaffirini's Staff will review and vet the proposed language. <br />VI. Question and Answer Session with Press and Public. <br />None. <br />VII.
