ASSOCIATE MUNCIPAL COURT JUDGE SERVICES CONTRACT <br /> This Associate Municipal Court Judge Services Contract ("Agreement" herein) <br /> is made and entered effective March 27, 2017 by and between Dallari Landry <br /> ("Judge"herein),an attorney licensed to practice law in the State of Texas, doing business at <br /> 217 Entre Rios, New Braunfels, Texas 78132, and the City of San Marcos, Texas ("City" <br /> herein), a home rule municipal corporation, doing business at 630 East Hopkins, San <br /> Marcos, Texas 78666. <br /> For and in consideration of the mutual agreements exchanged herein,Judge and City <br /> hereby contract as follows: <br /> 1. Engagement: City hereby engages Judge to perform and Judge agrees to <br /> perform judicial services during the term of her appointment to the office of <br /> Associate Judge of the San Marcos Municipal Court of Record in accordance <br /> with the laws of the State of Texas and the provisions of this Agreement. Judge <br /> is engaged to perform such services as an independent contractor of City and a <br /> judicial office holder and not as an employee of City. <br /> 2. Duties: Judge shall preside over Class C misdemeanor cases including <br /> violations of state law and city ordinances and other matters within the <br /> jurisdiction of the San Marcos Municipal Court of Record and shall additionally <br /> perform such administrative duties as are reasonably and customarily incident to <br /> her position as an Associate Municipal Judge. Judge shall uphold the integrity <br /> and independence of the judiciary, avoid the appearance of impropriety in all her <br /> activities and perform her duties impartially and diligently in accordance with <br /> and consistent with the Texas Code of Judicial Conduct. <br /> Judge agrees to perform the following judicial services pursuant to this <br /> Agreement: <br /> A. To be available to preside over cases on the Court's regularly scheduled and <br /> special dockets at least three (3) days per week, as necessary and as <br /> scheduled by the Court Administrator. Judge will also make herself <br /> available, upon reasonable notice, to sit for the Presiding Judge if and when <br /> he is unavailable to preside over the Court's regularly scheduled and special <br /> dockets. <br /> B. Preside over magistration proceedings for the Court (currently scheduled on <br /> weekends and holidays). <br /> C. Develop, coordinate, assist and be available to implement a DWI blood draw <br /> warrant program in conjunction with the San Marcos Police Department. <br />
