Agreement contains their entire and complete understanding of their contractual <br /> obligations to one another. <br /> 7. Modification. City and Judge agree that this Agreement may be modified only <br /> upon approval of the San Marcos City Council. <br /> 8. Termination. This Agreement shall become effective upon approval by the <br /> San Marcos City Council. This Agreement may be terminated by mutual <br /> agreement. City may terminate this Agreement, without recourse by Judge, if: <br /> a. Judge no longer holds the office of Associate Municipal Judge due to <br /> resignation, removal or suspension from office, or expiration and non-renewal <br /> of her term of office by the San Marcos City Council; or b. Judge fails to <br /> provide, refuses to provide, or becomes incapable of providing services in <br /> accordance with the terms of this Agreement. <br /> 9. Paragraph Headings: Paragraph headings have been used for convenience, <br /> only,and their description shall neither restrict nor expand their effect. <br /> 10.
