141 <br />Regular Meeting February 22, 1999 Page 6 <br />Mr. Moseley moved for adoption of the Resolution and Mr. <br />Mihalkanin seconded the motion. Mr. Taylor stated the taxes <br />owed are $13,000 and taxes exceed the value of the property. <br />Ms. Hughson noted the property has been off the tax rolls for <br />nine years. Mr. Gilley stated he recently discussed with the <br />County the City wants the collections moved along and more <br />marketing of the sales. The County will make a decision in the <br />near future regarding tax collection services. Mr. Hernandez <br />stated the value of the property is $9,000 and the offer is <br />$3,000. Mr. Mihalkanin stated with the property being in <br />disrepair, it will cost money to get the property in shape and <br />get it back on the tax rolls. On roll call the following vote <br />was recorded: <br />AYE: Mihalkanin, Hughson, Doiron, Moseley, Cox. <br />NAY: Hernandez. <br />ABSTAIN: None. <br />Mr. Cox introduced for consideration Item ll.D.(5) removed from <br />the consent agenda, adoption of a Resolution, the caption which <br />was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING A LICENSE AGREEMENT BETWEEN THE CITY AND <br />TEXAS CELLULAR TELEPHONE COMPANY, LLP, D/B/A AT&T WIRELESS <br />SERVICE, FOR THE USE OF A PORTION OF CRYSTAL RIVER PARKWAY <br />FOR DRIVEWAY ACCESS TO PROPERTY ADJACENT TO THE HILLS OF <br />HAYS SUBDIVISION; AUTHORIZING THE CITY MANAGER TO EXECUTE <br />THE LICENSE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Mihalkanin moved for adoption of the Resolution and Mr. <br />Hernandez seconded the motion. Ms. Hughson stated the City <br />should get income for the access and wanted to know the length <br />of license agreements. Mr. Taylor indicated the license <br />agreements are ongoing. Ms. Hughson requested information on <br />what license agreements we have and how other Cities handle <br />them. Ms. Hughson then moved to table the Resolution and Mr. <br />Mihalkanin seconded the motion, which passed unanimously (Mr. <br />Hernandez not present for the vote on this item). <br />Mr. Cox introduced a discussion regarding Texas Department of <br />Transportation issues. Ms. Hughson wants a status report from <br />TXDOT regarding a left turn lane on Ranch Road 12 and Bishop and <br />stated this would greatly increase the safety for citizens. She <br />also expressed a safety concern for the intersections, such as <br />at Hopkins and Bishop, with no left turn arrow signalization. <br />She expressed concern for the signage in San Marcos that reads, <br />"left turn yield on green". She wants to know how the City can <br />approach TXDOT with these safety issues. Mr. Gilley stated the <br />appropriate protocol would be to contact Mr. Needham by letter, <br />who is responsible for signalization. It would also be helpful <br />to discuss these issues from time to time with Russel Lenz, who <br />is the area engineer, and Staff does periodically make these <br />issues known to TXDOT. It would also be helpful to periodically <br />invite Mr. Lenz to a Council Meeting. The City does not always <br />get a response from TXDOT.
