Mr. Jenkins stated they are sometimes viewed <br />somewhere between maintenance and the capital improvements list. <br />If there is enough right-of-way and pavement to include a left <br />turn lane without construction and additional paving, that is <br />one circumstance. Mr. Jenkins stated if additional pavement is <br />required, his experience is TXDOT is not going to use the <br />shoulder, because the shoulder is not a full depth of base and <br />asphalt. They would need to do construction. Council asked <br />that the public submit other items of this type by March 31, <br />1999; and at that time Staff will prepare a comprehensive and <br />prioritized list and invite TXDOT to come to San Marcos. <br />Mr. Cox introduced a discussion regarding follow-up procedures <br />for Code violations. Mr. Cox discussed a circumstance where a <br />citizen has been dealing with a problem in his neighborhood for <br />at least three years. A citation was issued in Municipal Court <br />in November and mailed to the individual. The individual <br />rejected the mail, it was returned, and then there was no <br />follow-up. In discussions with the City Attorney's office, Mr. <br />Cox learned the Police Department, due to staffing <br />considerations, has a policy of not hand carrying municipal <br />court citations. Mr. Cox is concerned there is no follow-up <br />procedure. If the Police Department confronts the individual <br />again, such as with a traffic violation, the matter can be <br />handled at that time; otherwise there is no follow-up. Mr. Cox <br />thinks there needs to be a follow-up procedure. Mr. Gilley <br />stated a warrant is issued if there,is no response. The City <br />contracts with a company to handle outstanding warrants. Most <br />warrants are for traffic violations, and there are few warrants <br />issued for Code violations, such as this one. If an individual <br />was stopped, such as for a traffic violation, the previous <br />warrant would be of record. When this matter was brought to <br />Staff's attention, Chief Griffith contacted the Municipal Court <br />Clerk and learned there are two outstanding Code violation <br />warrants at this time. Chief Griffith has requested Municipal <br />Court forward Code violation warrants to his office and he will <br />send patrol staff to serve these. Mr. Cox stated he knows this <br />kind of issue builds frustration on the part of citizens, and <br />the Council expressed approval for Staff's response. Mr. Taylor <br />added the Council recently adopted an Ordinance providing ticket <br />writing authority to health inspectors, so the Police Department <br />will not necessarily have to be involved in having that citation <br />issued in person. Being issued a ticket is taken more seriously <br />than getting a letter from the Court and is more likely to lend <br />to compliance. This new policy has been implemented since that <br />arrest warrant was issued. <br />Mr. Cox introduced the City Manager's Report. Mr. Gilley had no <br />report at this meeting. <br />Mr. Cox introduced the City Attorney's Report. Mr. Taylor had <br />no report at this `meeting. <br />Mr. Cox introduced the City Council's Report. (1) Mr. Moseley <br />stated his request for information regarding tatoo parlors was <br />investigated by the Police Department, and their ads were racier <br />than what was found on site. (2) Mr. Doiron invited everyone to <br />come to Tanger on Wednesday, March 3 at 1:00 p.m. for the <br />dedication of the Police Substation for the officers' use. (3)
