ORDINANCE NO. 2017-36 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AMENDING VARIOUS SECTIONS OF SUBPART B, <br /> LAND DEVELOPMENT CODE, OF THE CITY'S CODE OF <br /> ORDINANCES TO CLARIFY THE APPLICABILITY OF <br /> NEIGHBORHOOD CHARACTER STUDIES TO VARIOUS REQUESTS <br /> AND DETERMINATIONS UNDER SUCH CODE; PROVIDING A <br /> SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF ANY <br /> CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE <br /> DATE. <br /> RECITALS: <br /> 1. City staff proposed and the Planning and Zoning Commission considered and <br /> recommended approval of amendments to Subpart B, Land Development Code,of the City's Code <br /> of Ordinances (the "Land Development Code") to clarify the applicability of Neighborhood <br /> Character Studies to various requests and determinations under the Land Development Code. <br /> 2. The City Council hereby finds and determines that the adoption of the following <br /> ordinance incorporating such revisions and amendments is in the interest of the public health, <br /> welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Land Development Code is amended as set forth below. Added text is <br /> indicated by underlining. Deleted text is indicated by strikethroughs. <br /> SECTION 2. Section 1.4.1.5 is amended to read as follows: <br /> Section 1.4.1.5 Criteria for Approval <br /> The Planning and Zoning Commission in making its recommendation and the <br /> City Council in taking action on the request for amendment of the Comprehensive <br /> Plan shall consider the following criteria: <br /> (a) For text amendments, whether the amendment is consistent with other <br /> policies of the Comprehensive Plan,taking into account the nature of any <br /> proposed map amendment associated with the text amendment; <br /> (b) Whether the amendment promotes the orderly and efficient growth and <br /> development of the community and furthers the public health, safety and <br /> general welfare of the City; <br />
