ARTICLE 2 <br /> THE CITY'S RESPONSIBILITIES <br /> The City will: <br /> 2.1 Provide full information to the Engineer regarding the City's requirements for the <br /> Engineer's services under this Agreement. The City will furnish the Engineer with copies of data <br /> and information in the City's possession needed by the Engineer at the Engineer's request. The City <br /> will provide this information and render decisions expeditiously for the orderly progress of the <br /> Engineer's services. The City will provide GIS data and as-built plans for infrastructure within the <br /> proposed project limits, coordination with utilities and the Jail, and staff input. <br /> Designate Kirk Abbott,P.E.,Engineer or his designee as the City's Project Manager and authorized <br /> representative to act on the City's behalf with respect to this Agreement. The City will examine <br /> the documents and information submitted by the Engineer and promptly render responses to the <br /> Engineer on issues requiring a decision by the City. <br /> Provide access to and make all necessary provisions for the Engineer to enter public and private <br /> property as required for the Engineer to perform its services under this Agreement. <br /> Be responsible for securing all federal and state required permits required for the construction of <br /> this Project with the assistance of the Engineer. <br /> Bear all other costs incidental to this Article. <br /> ARTICLE 3 <br /> REIMBURSABLE EXPENSES <br /> 3.1 Reimbursable expenses, including such things as expenses for plotting, reproduction of <br /> documents, auto travel mileage (at the prevailing IRS rate), delivery charges, long distance <br /> communications, freight, and state accessibility review are included in the Engineer's basic <br /> services compensation. <br /> ARTICLE 4 <br /> PAYMENTS TO THE ENGINEER <br /> 4.1 PAYMENTS FOR BASIC SERVICES <br /> The City will pay the Contractor for Basic Services on a monthly basis following receipt by the <br /> City of the Contractor's invoices showing direct and indirect labor costs, expenses for materials <br /> and supplies and any other reimbursable expenses if applicable, and appropriate payment <br /> requisitions. The Contractor will base its invoices upon the extent of work it has completed on an <br /> hourly basis within each task of services less any disputed amounts,pending resolution thereof <br /> The total not-to-exceed amount the City will pay the Contractor for the professional services <br /> described in this Agreement is $677,419.
