<br />49 <br /> <br /> <br /> <br />Regular Meeting March 22, 1999 Page 6 <br /> <br />Mayor Moore introduced for consideration, Item 8.D.(3), adoption of a Resolution, removed <br />from the consent agenda, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AMENDED TAX <br />ABATEMENT AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND THE <br />HEB GROCERY COMPANY FOR A MECHANIZED DISTRIBUTION WAREHOUSE <br />FACILITY TO BE CONSTRUCTED IN THE 2300 BLOCK OF HUNTER ROAD; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moseley moved for adoption of the Resolution and Mr. Hernandez seconded the motion. <br />Mr. Moseley stated he does not feel a tax abatement is needed to do this project. Mr. Gilley <br />stated the Council has encouraged this type of abatement because it meets the criteria. The <br />Council then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Moore introduced for consideration, Item 8.D.(7), adoption of a Resolution, removed <br />from the consent agenda, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE SALE OF LOT 3A, BLOCK 11, D.S. COMBS ADDITION <br />TO ARTURO MACHADO; AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />DEED; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution and Mr. Cox seconded the motion, which <br />passed unanimously. (Mayor Moore not present for roll call). <br /> <br />Mayor Pro-Tern Cox introduced for consideration, Item 8.D.(8), adoption of a Resolution, <br />removed from the consent agenda, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, REJECTING ALL BIDS SUBMITTED FOR UTILITY VEHICLES FOR THE <br />POLICE DEPARTMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution and Ms. Hughson seconded the motion, <br />which passed unanimously. <br /> <br />Mayor Moore introduced for consideration, Item 8.D.(16), adoption of a Resolution, removed <br />from the consent agenda, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING A LICENSE AGREEMENT BETWEEN THE CITY AND <br />TEXAS CELLULAR TELEPHONE COMPANY, LLP, D/B/A AT&T WIRELESS <br />SERVICE, FOR THE USE OF A PORTION OF CRYSTAL RIVER PARKWAY FOR <br />DRIVEW A Y ACCESS TO PROPERTY ADJACENT TO THE HILLS OF HAYS <br />SUBDIVISION; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />LICENSE AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Cox moved for adoption of the Resolution and Mr. Mihalkanin seconded the motion. <br />Discussion ensued. Ms. Hughson moved to amend the License Agreement under Consideration <br />to read "Twenty-five dollars per year and other good and valuable consideration, including the <br />Licensee's performance of its obligations under this agreement." and Mr. Hernandez seconded <br />the motion. On roll call the following vote was recorded: <br /> <br />AYE: Hernandez, Hughson, Cox. <br /> <br />NAY: Mihalkanin, Moore, Moseley. <br /> <br />ABSTAIN: None. <br />. ..- -.- <br />
