<br />51 <br />Regular Meeting March 22, 1999 Page 8 <br />of the City Limits versus ETJ and some distinction should be made between small and large <br />parcels. The citizens are concerned with the composition of the appeals process and he thinks <br />the citizens should be involved with this process. Mr. Cooper wants the initial appeal to go <br />before a small group and then to the City Council. Mr. Cooper pointed out, the draft is written <br />with only two bases to appeal, being the assignment of the property has been incorrectly made <br />residential or commercial, or secondly, there has wrongly been assigned a number of residences <br />to the property. The Council would like Staff to make recommendations including the <br />appropriate ETJ areas. <br />Mayor Moore introduced a discussion item regarding the status of the Texas Department of <br />Transportation Road Projects in San Marcos. Mr. Lenz is not present and this item will come <br />back on a future agenda. <br />Mayor Moore introduced the City Manager's Report. Mr. Gilley stated the Council received a <br />draft proposal agenda for a Neighborhood Meeting regarding the cross-town road. The agenda <br />will be available in Spanish and mailed out to all residents in the neighborhood with a follow-up <br />of a door-to-door delivery. <br />Mayor Moore introduced the City Attorney's Report. Mr. Taylor had no report at this meeting. <br />Mayor Moore introduced the City Council's Report. I.) Ms. Hughson stated on April 30, 1999 <br />there will be an all day conference of the Aftermath of the October Flood and the registration fee <br />is $35.00. The offer is still available if anyone wishes to see the Flood Control Dam on Sink <br />Creek. 2.) Mr. Cox stated Phil Neighbors sent an e-mail to him reporting New Braunfels received <br />$400,000 of equipment to fix drainage problems and he has given that information to Ms. <br />Huffman for research. 3.) Mr. Hernandez stated he received information from the <br />Commissioner's Court regarding delinquent tax collection and their process. He would like to <br />see this item on a future agenda. 4.) Mayor Moore stated the 2000 Census is done by the Staff <br />for the City and the County is very much involved, and we need to strive for an accurate count. <br />We need to involve groups to get the word out to the Community. <br />Mr. Moseley moved to adjourn at 11 :07 p.m. into Executive Session pursuant to Government <br />Code, Section 551.071, to discuss contemplated litigation (X-Squeeze Me! Juice, Inc.) and <br />matters where the City Attorney's ethical duty to the City clearly conflicts with Government <br />Code Chapter 551 (economic development along Clovis Barker Drive; T.B. Woods tax <br />abatement); and Sections 551.072 and 551.073, to discuss the purchase of real property <br />(parkland) and Mr. Hernandez seconded the motion, which passed unanimously. <br />Mr. Mihalkanin moved to reconvene from Executive Session at 12:01 a.m. and Mr. Moseley <br />seconded the motion, which passed unanimously. <br />Mr. Mihalkanin moved to adjourn the meeting at 12:02 a.m. and Ms. Hughson seconded the <br />motion, which passed unanimously. <br />, <br /> Billy G.
