<br />I <br /> <br />I <br /> <br />- <br /> <br />ARTICLE 3 <br />PAYMENTS <br /> <br />3.1 RATES AND BILLING <br /> <br />3.1.1 BFI will bill the City for service rendered to residential units during a month within <br />ten (10) calendar days following the end of the month and the City will pay BFI on or before <br />the 25th day following the end of the preceding month. Such billing and payment will be <br />based on the price rates and schedules set forth in subsection 3.1.2 of this Contract. BFI <br />will receive payment for services rendered to residential units whether or not the City <br />collects from the customer for such service. <br /> <br />3.1.2 The rates charged by BFI will be as follows: <br /> <br />Residential Unit Rate Per Month...................................................$11.23 <br /> <br />Other Fees: <br /> <br />City Facilities and Permanent Activities........................ ..$2,000.00/month <br />Sludge Collection at WWTP six days per week....................$298.00/haul <br />Neighborhood Cleanup................................................... .$1,4 70.00/event <br /> <br />3.2 CALCULATION OF PAYMENTS FOR RESIDENTIAL DWELLING UNITS <br /> <br />3.2.1 Payment for each month's service will be determined by applying the contract unit <br />price for collections to the actual number of occupied residential dwelling units within the <br />contract area during the immediately preceding month as shown by the City's utility billing <br />records. <br /> <br />3.2.2 New accounts added after the first day of a month will be counted as having <br />received service for a full month. Accounts discontinued during a given month will be <br />counted as not having received service for that month, as determined by the above- <br />described reports. <br /> <br />3.2.3 If BFI disagrees with the City's records in the number of units serviced for a given <br />month, BFI will specify the nature of the disagreement, the address(es) of the unit(s) in <br />question, the type of service being provided, and the date such service began or ended. <br />The City will investigate reported discrepancies and confirm or deny BFI's request. The <br />City will decide the issue in a fair and reasonable manner, and the City's decision is final. <br />BFI will continue to provide collection services until resolution is reached. <br /> <br />3.3 BFI may request in writing that payments due or to become due to it be assigned <br />to a bank or other financing institution, provided that prior written approval is obtained <br />through the City Manager, and payment by the City is made only to one party.
