All recyclable materials collected by BFI will become its property. 1.3.4 Furnish each residential unit with a recycling bin. 1.3.5 Not limit, except as may otherwise be noted in this Contract, the amount of recyclables residents place out for removal Residents will not be required to separate materials by types, but they will be required to use recycling bins provided by BFI for setting out materials for pickup. 1.3.6 Notify the City of all materials not collected and the reason for it. The City will then investigate all "no pickups" and advise the resident of the reasons, or require BFI to collect the material. The City will act in a fair and reasonable manner in deciding these issues, and the City's decision will be final. 1.3.7 Discontinue recyclable collection service to any location as set forth in a written notice sent to BFI by the City. BFI will resume collection service at the location on the next regularly scheduled collection day upon written notice from the City. 1.3.8 Comply with all applicable State of Texas rules and regulations when operating on the separation/processing site. BFI will dispose of materials which cannot be utilized by recycling markets at a legally permitted municipal solid waste facility. Contaminated recyclable materials collected from residences in the contract area may be disposed of by BFI. BFI's failure to operate its processing site in accordance with all applicable regulations will be considered as being in non-compliance with this Contract. Recycling Drop-off Center/City Office Recyclables Pickup 1.3.9 Provide for the operation through a subcontractor of a Recycling Drop-off Center within the City to collect recyclable materials from the public. The subcontractor will be required to proVide appropriate supervision, materials, equipment, and labor for the operation of the Recycling Drop-off Center as follows: A.
