166 <br />Regular Meeting August 9, 1999 Page 7 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE PURCHASE OF ONE LAPTOP COMPUTERAND EIGHT <br />PERSONAL COMPUTERS FOR MUNICIPAL COURT FROM GATEWAY COMPUTERS <br />THROUGH THE STATE GENERAL SERVICES COMMISSION'S CATALOGUE <br />PURCHASING PROCEDURE; AUTHORIZING THE PURCHASING MANAGER TO <br />EXECUTE PURCHASING DOCUMENTS ON BEHALF OF THE CITY AND <br />DECLARING AN EFFECTIVE DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LEASE.AGREEMENT <br />BETWEEN THE CITY AND THE CENTRAL TEXAS PEPPER FARM CO- <br />OPERATIVE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Mihalkanin introduced for consideration Item 10.B. removed from <br />the consent agenda, approval of an ordinance on second reading, the <br />caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 98.031 OF THE CITY CODE TO REVISE THE <br />AREAS OF SPECIAL FLOOD HAZARD WITHIN THE CITY; INCLUDING <br />PROCEDURAL PROVISIONS AND PROVIDING A PENALTY; AND PROVIDING AN <br />EFFECTIVE DATE. <br />Mr. Moseley moved for approval of the Ordinance on second reading <br />and Mr. Hernandez seconded the motion, which passed unanimously. <br />Mr. Mihalkanin introduced for consideration Item 10.D.(7) removed <br />from the consent agenda, adoption of a Resolution, the caption which <br />was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE REALLOCATION OF COMMUNITY DEVELOPMENT <br />BLOCK GRANT FUNDING FROM THE FLOOD MITIGATION ASSISTANCE <br />PROGRAM TO PHASES III AND IV OF THE DOWNTOWN SIDEWALK PROJECT; <br />AND DECLARING AN EFFECTIVE DATE. <br />Mr. Hernandez moved for adoption of the Resolution and Ms. Hughson <br />seconded the motion, which passed unanimously. <br />Mr. Mihalkanin introduced for consideration Item 10.D.(8) removed <br />from the consent agenda, adoption of a Resolution, the caption which <br />was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING REVISIONS TO THE CITY'S REVISED FLOOD <br />MITIGATION ASSISTANCE PROGRAM GUIDELINES; AND DECLARING AN <br />EFFECTIVE DATE. <br />Ms. Hughson moved for adoption of the Resolution and Mr. Hernandez <br />seconded the motion. Mr. Moseley moved to amend the Resolution in <br />Part 1 to read, "Purchase of lot/structure (as is)-increase from <br />$15,000 to $60,000 maximum," and Ms. Hughson seconded the motion, <br />which passed unanimously. Mr. Gilley advised of other issues Staff <br />has: the CDBG fund criteria program is designed to raise homes or <br />eliminate structures. Mitigation is required by FEMA once damage <br />exceeds 50% (FEMA $26,400 maximum damage [value of home]). The <br />value of homes exceeds the allowance of raised homes. Staff needs a <br />description. The Council wants to deal with homes in the 100 year <br />floodplain first, then those beyond that with a sliding scale. <br />Kathy Morris, representing Lillian Washington, advised Ms. <br />Washington's home at 501 S. Mitchell had been flooded five times and <br />renovated four. She recommended the Council buy her home and others <br />along the creek. Helena Perez, representing Mrs. Mendoza (99 years <br />old) stated her home was flooded and is now unstable and she is <br />living in the home and needs help. Mr. Gilley advised FEMA is
