Secs. 74.0298-74.055. Reserved. <br /> SECTION 19. Section 74.105 of the San Marcos City Code is hereby amended as set <br /> forth below. <br /> Sec. 74.105. Removal of obstruction by executive director of public works <br /> services. <br /> • <br /> • <br /> • <br /> Nothing in sections 74.102, 74.103 or 74.104 will affect the authority of <br /> the director of public works to summarily remove an obstruction from an alley <br /> without prior notice if the director determines this is in the interest of the public <br /> health, safety and welfare. If the director summarily removes an obstruction, the <br /> director will send a notice within ten days to the person who constructed, placed <br /> or maintained the obstruction stating the reason for the removal. <br /> SECTION 20. Chapter 74, Article 3, Sidewalks, Section 74.121 of the San Marcos City <br /> Code is hereby amended as set forth below. <br /> Sec. 74.121. Definitions. <br /> In this division: <br /> Corner lot means a tract of property located at the intersection of two <br /> streets. <br /> Curb line means the physical edge of that portion of any street which is <br /> improved, designed or ordinarily used for vehicular traffic. <br /> Shrub means any hedge, bush, shrubbery, vine, palm or other similar <br /> vegetation, except trees. <br /> Traffic means pedestrians, bicyclists,riders of animals, drivers of vehicles, <br /> while using any street for purposes of travel. <br /> Tree means any self-supporting woody plant species which normally grows <br /> to a height of 15 feet or more. <br /> Vehicle means every device in,or by which any person or property is or may <br /> be transported or drawn upon a street, except devices moved by human power. <br />
