(d) Any necessary boring for line extensions will be at the applicant's <br /> expense. <br /> (e) Ownership of line extensions, appurtenances and facilities will be <br /> transferred to the city upon final acceptance of the improvements by the city. <br /> Operation and maintenance of the improvements will become the responsibility of <br /> the city upon final acceptance, with the exception of any warranty items. <br /> Sec. 86.0043. Extensions and connections to city water or wastewater system <br /> outside the city limits. <br /> (a) Applications for service connections to existing city water or <br /> wastewater lines to serve a property located outside the city limits will be granted <br /> only with the approval of the city manager. Each such application must be <br /> accompanied by a written request for annexation of the applicant's property. <br /> (b) Applications for extension of city water or wastewater lines to serve <br /> a property located outside the city limits will be granted only with the approval of <br /> the city council. An application for approval of such an extension must be <br /> accompanied by a written request for annexation of the applicant's property. If the <br /> property is not contiguous to the city limits, the application must be accompanied <br /> by a written request for annexation of an area at least 15 feet in width from each <br /> property owner or, for public right-of-way, the entity having jurisdiction over the <br /> right-of-way, along the intended route of the line extension. <br /> (c) Annexation requests must be submitted on forms approved by the <br /> city. <br /> Sec. 86.0054. Extension of lines by city at owner or developer's expense. <br /> (a) Request to city. In connection with an application for extension of a <br /> water or wastewater line,the owner or developer of property may submit a request <br /> to pay the city to construct a water or wastewater line to serve development on the <br /> property in lieu of construction by the owner or developer. <br /> (b) City approval of request. The city may, but shall not be required to, <br /> construct a water or wastewater line with funds provided by the owner or developer <br /> to serve a development in lieu of construction by the owner or developer subject to <br /> any requirements of this section and any terms and conditions imposed by the city <br /> council. Before the city may construct facilities under this section, the owner or <br /> developer shall execute an agreement approved by the city council setting forth the <br /> terms and conditions under which the city will perform such service. <br /> (c) Bidding and contract. If the city agrees to extend the water or <br /> wastewater line, the city's procedures for competitive bidding and the award of <br /> contracts established by applicable provisions of the Texas Local Government <br />
