option to have a Manual Read Electric Meter. If the property owner <br /> wishes to place the AMI meters in a location where they do not <br /> properly communicate the owner shall either work with SMEU to <br /> correct the problem,or pay a manual read fee. If approved,the utility <br /> account holder agrees to: <br /> a. Pay a Meter Exchange Fee of$100.00 to replace an AMI <br /> Meter with a Manual Read Meter, and <br /> b. Pay a monthly Meter Reading Fee of$25.00, in addition <br /> to the existing electric utility charges. <br /> SECTION 35. Chapter 86,Article 5,Division 4,Impact Fee Ordinance of the City of San <br /> Marcos, Section 86.303 of the San Marcos City Code is hereby amended as set forth below. <br /> Sec. 86.303. Appeals. <br /> (a) Applicability. The property owner or applicant for new development <br /> may appeal the following administrative decisions to the city council: <br /> (1) The applicability of an impact fee to the development; <br /> (2) The amount of the impact fee due; <br /> (3) The availability of, the amount of, or the expiration of an offset or <br /> credit against payment of an impact fee for inclusion in a subdivision <br /> improvement agreement; <br /> (4) The expiration of any other offset or credit <br /> (45) The application of an offset or credit against an impact fee due; <br /> (36) The amount of the impact fee in proportion to the benefit received <br /> by the new development; <br /> (67) The availability of or amount of a refund due, if any; or <br /> (78) The applicability of an exception or exemption; or <br /> (b) Exception. If the property owner or applicant contends that the <br /> amount of the impact fee or the availability or amount of an offset or credit against <br /> an impact fee due places a disproportionate burden on the property owner or <br /> applicant,or that payment of the impact fee exceeds the benefit that payment of the <br /> impact fee exceeds the benefit received by the new development,the procedures of <br /> this Section do not apply. In such instance, the property owner or applicant shall <br /> file a petition for relief from a dedication or construction requirement under the <br />
