Regular Meeting May 24, 1999 Page 8 CHAPTER 86 - UTILITIES OF THE SAN MARCOS CITY CODE TO ADD ARTICLE 8 - DRAINAGE UTILITY; DEDICATING CITY-OWNED ASSETS TO THE UTILITY; ESTABLISHING A SERVICE AREA FOR THE UTILITY; AUTHORIZING THE PLANNING AND ENGINEERING DEPARTMENTS TO PROMULGATE RULES AND REGULATIONS FOR THE EFFICIENT ADMINISTRATION OF THE DRAINAGE UTILITY; ESTABLISHING THE DRAINAGE ADVISORY BOARD BY AMENDING CHAPTER 2, ARTICLE 3, DIVISION 7; AND PROVIDING AN EFFECTIVE DATE. Mr. Mihalkanin moved to remove the Ordinance from the table and for approval on second reading and Ms. Hughson seconded the motion. Mr. Gilley stated the questions raised at last Thursday's meeting need to be addressed, including the discussion regarding a tiered rate structure (by size) and credits/waivers for businesses. Mr. Mihalkanin stated it had been a cooperative meeting and Laura Huffman and Vicky Williams provided good background information. There was a lot of informational discussion. Mr. Mihalkanin then moved to table the matter until the next Regular Meeting and Ms. Hughson seconded the motion, which passed unanimously. Mayor Moore introduced for consideration reconsideration of a Zoning Ordinance. The Council did not wish to reconsider the Ordinance. The caption of the Ordinances reads as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING A 73.543 ACRE TRACT OF UNZONED PROPERTY LOCATED IN THE 3800 BLOCK OF IH35 SOUTH AS "C" (COMMERCIAL DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Moore introduced for consideration removal from the table and approval of minutes of the Regular Meeting held April 26, 1999, approval of minutes of the Regular Meeting held May 10, 1999, approval of three Ordinances on second reading, adoption of two Ordinances on third and final reading, and adoption of nine Resolutions on consensus. The Council removed Item 11.B. (3), approval of Ordinance on second reading, Item 11.C. (2), adoption of Ordinance on third and final reading, and Items 11.D. (3) and 11.D. (7), adoption of Resolutions, to be considered separately. Mr. Hernandez moved to remove from the table and approve the minutes of the Regular Meeting held April 26, 1999, approve the minutes of the Regular Meeting held May 10/ 1999, approve the two remaining, Ordinances on second reading, adopt the remaining Ordinance on third and final reading, and adopt the remaining seven Resolutions on consensus and Mr. Mihalkanin seconded the motion, which passed unanimously (Mr. Moseley voting Nay on Item 11.B. [2J, approval of Ordinance on second reading). The captions of the Ordinances and Resolutions read as follows: Approval of Ordinances on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING VARIOUS PROVISIONS IN CHAPTER 94, ARTICLE 4 OF THE CITY CODE TO UPDATE AND CLARIFY THE SAN MARCOS RIVER CORRIDOR ORDINANCE; PROVIDING FOR PENALTIES; AND INCLUDING PROCEDURAL PROVISIONS. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, PROHIBITING BEGGING, CAMPING, URINATING AND DEFECATING IN PUBLIC AREAS OF THE CITY BY AMENDING CHAPTER 34 - ENVIRONMENT BY ADDING DIVISION 3, PUBLIC NUISANCES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Adoption of Ordinance on third and final reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 90.131 OF THE CITY CODE TO REDUCE THE REQUIRED HOURS
