<br />Regular Meeting November 22, 1999 Page 2 <br /> <br /> <br />TRACT OF PROPERTY LOCATED AT 1631 AQUARENA SPRINGS DRIVE, FROM "C" <br />(COMMERCIAL DISTRICT) TO "MF-5" (MULTI-FAMILY DWELLING QISTRICT [HIGH <br />DENSITY]); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Moore closed the public hearing. Ms. Hughson moved <br />for adoption of the Zoning Ordinance and Mr. Cox seconded the motion, <br />which passed unanimously. <br /> <br />Mayor Moore introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING ARTICLE 2, MASTER PLAN, OF CHAPTER 102, PLANNING, OF THE <br />CITY CODE TO AMEND THE SAN MARCOS HORIZONS CITY MASTER PLAN ADOPTED <br />IN SECTION 102.026 BY ADOPTING A NEW CHAPTER 4, ANNEXATION; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Moore closed the public hearing. Mr. Doiron moved <br />for approval of the Ordinance on first reading and Mr. Moseley seconded <br />the motion. Mr. Patterson advised the Council the Legislature has made <br />significant changes regarding annexations. There is more involvement with <br />the area to be annexed. The City cannot annex less than 1000 feet unless <br />it is at the request of a landowner or is municipally owned property. <br />Infrastructure must be completed within 2-1/2 years of annexation. All <br />sections of Willow Creek, Turkey Hollow and Laurel Estates area will be a <br />policy decision. If the Council wishes to annex the area, it should be <br />done within the 3-year transition period. Some of the area is built to <br />City standards, and some is not. It was consensus of Council for the <br />Annexation Review Program to be added at second reading of the Ordinance. <br />The Council indicated they want to look at these areas specifically, and <br />Ms. Hughson stated she wants the Council to also consider Quarry Spring. <br />The Council voted unanimously for approval of the Ordinance on first <br />reading. <br /> <br />Mayor Moore introduced for consideration adoption of an Ordinance on third <br />and final reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE CITY BUDGET ORDINANCE FOR THE 1999-2000 FISCAL YEAR TO <br />PROVIDE FUNDING FOR ACQUISITION OF PROPERTY IN THE SESSOM GREENBELT <br />AREA AND IN THE WESTOVER ADDITION AREA; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Cox filed a disclosure affidavit with the City Secretary, as he owns <br />property in the area and left the Council Chambers during the <br />consideration of this matter. Mr. Moseley moved for adoption of the <br />Ordinance on third and final reading and Mr. Doiron seconded the motion. <br />Mr. Hernandez moved to amend the Ordinance caption to add, "Sessom <br />Greenbelt Area and in the Westover Addition Area," and add to the end of <br />the sentence in Section 1, "and in the Westover Addition Area," and Ms. <br />Hughson seconded the motion, which passed unanimously. The Council then <br />voted unanimously for adoption of the Ordinance on third and final <br />reading. <br /> <br />Mayor Moore introduced for consideration adoption of a Resolution, the <br />caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ALLOCATING THE CITY'S BASE AMOUNT OF TELECOMMUNICATIONS FEE REVENUE <br />AMONG CATEGORIES OF TELECOMMUNICATIONS ACCESS LINES; AND DECLARING AN <br />EFFECTIVE DATE. <br />
