RegulaJ:Meeting October 11, 1999 Page 2 Mayor Moore introduced for consideration approval of four appointments to the Library Board. Mayor Moore moved to reappoint John Ferguson (in), appoint Bill Mears (ETJ) and appoint Nikki Hendricks (ETJ), Mr. Doiron moved to appoint Bill DeSoto (in) and Mr. Cox moved to appoint W. Bailey Barton (ETJ). On roll call for the two representatives from outside the City limits, the following vote was recorded: BARTON: Hughson, Moseley, Cox, Hernandez. MEARS: Mihalkanin, Doiron, Moore, Moseley, Hernandez. HENDRICKS: Mihalkanin, Hughson, Doiron, Moore, Cox. The Council then voted unanimously for approval of two appointments of members who reside in the City limits: appointment of Bill DeSoto and reappointment of John Ferguson. The four appointments to the Library Board are Bill Mears, Nikki Hendricks, Bill DeSoto and John Ferguson. Mayor Moore introduced for consideration approval of one appointment to the Planning and Zoning Commission to complete a vacancy. Mr. Mihalkanin moved to appoint Scott Walker (City) and Ms. Hughson moved to appoint Dr. William R. (Randy) Rogers (City). On roll call the following vote was recorded: WALKER: Mihalkanin. ROGERS: Hughson, Doiron, Moore, Moseley, Cox, Hernandez. Mayor Moore introduced for consideration confirmation of the City Manager's appointment to the Civil Service Commission. Mr. Cox moved to confirm Mr. Gilley's reappointment of Rene Ferrer and Mr. Doiron seconded the motion, which passed unanimously. Mayor Moore introduced for consideration a public hearing and adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID WASTE AND RECYCLABLE MATERIALS; INCLUDING PROCEDURAL PROVISIONS AND DECLARING AN EMERGENCY. Mayor Moore opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Moore closed the public hearing. Mr. Moseley moved for adoption of the Ordinance on emergency and Mr. Cox seconded the motion. Mr. Hernandez stated he had concerns regarding BFI's performance and wants to discuss this Ordinance in conjunction with the Resolution regarding BFI's contract later in the meeting. Mr. Hernandez then moved to table this matter and Mr. Mihalkanin seconded the motion. On roll call the following vote was recorded: AYE: Mihalkanin, Hughson, Doiron, Moore, Cox, Hernandez. NAY: Moseley. ABSTAIN: None. Mayor Moore introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 18, ARTICLE 3, FOOD SERVICE ESTABLISHMENTS, OF THE CITY CODE BY ADOPTING THE MOST RECENT TEXAS RULES FOR FOOD OPERATIONS AND REVISING SECTIONS RELATED TO REMEDIES AND APPLICATIONS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mr. Doiron moved for approval of the Ordinance on first reading and Mr. Hernandez seconded the motion, which passed unanimously.
