<br />specfal Meeting September 7, 1999 Page 2 <br /> <br /> <br />Mayor Moore introduced for consideration a public hearing and approval <br />of an Ordinance on first reading, the caption which was r~ad as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 18.090 OF THE CITY CODE REGARDING FEES CHARGED BY <br />THE ENVIRONMENTAL HEALTH DEPARTMENT; INCREASING THE AMOUNTS OF <br />VARIOUS FEES FOR FOOD SERVICE ESTABLISHMENTS; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Ms. Huffman advised the Council David Griffith's study looked at the <br />fee structure and determined we were only covering 20% of our costs and <br />Staff is recommending this amendment which would cover 50% of our costs <br />and is consistent with other cities in the area. Mayor Moore opened <br />the public hearing and asked if anyone wished to speak. No one did, so <br />Mayor Moore closed the public hearing. Mr. Doiron moved for approval <br />of the Ordinance on first reading and Ms. Hughson seconded the motion. <br />Mr. Brinkley stated he does not think businesses will find this fee to <br />be exorbitant. In November businesses will be mailed information their <br />current certificates will be expiring and be advised of the new fee. <br />Ms. Hughson suggested businesses be advised there will be an increase <br />after the Ordinance is adopted rather than wait until November. Mr. <br />Moseley suggested Staff communicate with the businesses the fee is <br />going up and why. The Council voted unanimously for approval of the <br />Ordinance on first reading. <br /> <br />Mayor Moore introduced for consideration a public hearing and approval <br />of an Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 14.051 OF THE CITY CODE TO PROVIDE FOR FEES TO BE <br />CHARGED FOR HOMEOWNER PROJECT REGISTRATION AND REGISTRATION OF <br />FIRE SPRINKLER INSTALLERS AND IRRIGATION SYSTEM INSTALLERS; <br />AMENDING SECTION 14.377 OF THE CITY CODE TO PROVIDE FOR A FEE TO <br />BE CHARGED FOR RECIPROCAL LICENSE LETTERS FOR ELECTRICIANS; <br />SETTING AND INCREASING THE AMOUNTS OF VARIOUS DEVELOPMENT-RELATED <br />FEES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mayor Moore opened the public hearing and asked if anyone wished to <br />speak. Dianne Wassenich stated she was present at the Planning and <br />Zoning Commission meeting when this matter was before them. She stated <br />the developers are not being held to our Ordinances, and we need to get <br />tougher on developers and need to raise our fees to cover costs. No <br />one else wished to speak, so Mayor Moore closed the public hearing. <br />Mr. Doiron moved for approval of the Ordinance on first reading and Ms. <br />Hughson seconded the motion. Mayor Moore read into the record <br />information from the 1997 cost of service study by David Griffith. Ms. <br />Hughson asked Mr. Patterson if other cities charge higher fees in the <br />ETJ. Ms. Hughson wants Staff to see if legally higher fees can be <br />charged in the ETJ. Mr. Patterson stated the Planning and Zoning <br />Commission wanted to charge lesser fees for smaller parcels, and Ms. <br />Hughson expressed concern development may occur in a small piecemeal <br />fashion to keep costs down. Ms. Hughson then moved to amend Section 4 <br />and a portion of Section 5 as follows: Administrative minor plat <br />$50/acre, $100 min., Minor Plat (P&Z Comm.Review) $50/acre, $100 min., <br />Subdivision Master Plan $50/acre, $150 min., Preliminary plat $30/acre, <br />$250 min.; Zoning to multi-family (all categories) $100/acre, $250 <br />min., To commercial or industrial (all categories) $100/acre, $250 <br />min., Master plan land use amendments: As separate amendment $100/acre, <br />$500 min. Mr. Moseley seconded the amendment, which passed <br />unanimously. Ms. Hughson then moved to amend Section 5, Specific use <br />permits, Fraternity or sorority house $500, Manuf. Home as security <br />office $500, and Telecommunications towers $1,000 (these three being <br />recommendations of P&Z Comm.) and the remainder of the Specific use <br />
