18. Consider adoption of Ordinance 2009-41 on emergency, amending the City's 2008-2009 • <br />budget to authorize the expenditure of funds in the sum of 5262,609 for the completion of <br />the construction funding for the air traffic control tower; declaring an emergency and <br />providing an effective date; and declaring an emergency. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Terry, the City Council voted seven (7) for and none (0) opposed, to adopt Ordinance 2009-41 <br />on emergency, as previously captioned. The motion carried unanimously. <br />19. Consider adoption of Ordinance 2009-46 on emergency, ordering a General Election to <br />be held on November 3, 2009 for the purpose of electing a City Council Member, Place 5, <br />and a City Council Member, Place 6, establishing early voting locations and polling places <br />for this election; making provisions for conducting the election; and declaring an <br />emergency. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Terry, the City Council voted seven (7) for and none (0) opposed, to adopt Ordinance 2009-46 <br />on emergency, as previously captioned. The motion carried unanimously. <br />20. Consider an ordinance amending Article 2, Division 2 of Chapter 86, Water <br />Conservation, of the San Marcos City Code; and providing an effective date; and consider <br />ordinance on first of two readings. • <br />MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Couch, and amended to clearly state that residential water customers may request, through the <br />variance process, a different watering day that they will have for a variance period of one year <br />and to remove recital number 2, the City Council voted six (6) for and one (1) opposed, with <br />Councilmember Bose voting against, to approve the ordinance on first reading. The motion <br />carried. <br />21. Discussion on the need for amendments to the Taxicab Ordinance and provide <br />direction to staff. <br />The City Council discussed the need for amendments to the Taxicab ordinance. Staff was <br />directed to bring back menu items provided by the Extended Hours Task Force. It was also <br />recommend that the fares be posted in the cabs. <br />22. Presentation by TDS and discussion on the status of Residential Single Stream <br />Recycling/Rewards Program and update on Multi-familv /Commercial Single Stream <br />Recycling and provide direction to staff. <br />Ryan Beard, representing TDS, provided a quarterly status report on the Single Stream <br />Recycling program. He also reported on a new rewards program. TDS Smart Rewards Program <br />is the first of its kind in Central Texas and is expected to launch October 1. • <br />RM080409 Minutes Page 6
