Amend subsection (d) of Section 3.11 regarding public hearings on proposed <br /> ordinances as follows: <br /> (d) All proposed ordinances requiring a public hearing or hearings shall be finally <br /> acted upon by the city council within ninety (90) days of the most recent public hearing. <br /> If final action does not occur i3 not had within the Stteft ninety (90) day period following <br /> the Stteh public hearing, then another public hearing shall be held before final action on <br /> the ordinance. Unless notice requirements are provided by other law, the city secretary <br /> shall publish a notice of each public hearing by the city council on an ordinance in a <br /> newspaper of general circulation in the city before the public hearing. <br /> ********** <br /> Rationale: The changes to the existing text modernize the wording. The added sentence will <br /> establish a baseline requirement for notice of all public hearings on ordinances. Presently, <br /> notice is required only of public hearings on certain ordinances, such as rezonings, setting <br /> of the tax rate, and adoption of the budget. <br /> 5. Amend Section 3.13 regarding the compiling and publishing of a code of ordinances <br /> as follows: <br /> Sec. 3;13. Code of ordinances. <br /> The council shall cause all general ordinances of the city to be compiled and printed <br /> in code form. Every general ordinance enacted subsequent to such codification shall be <br /> enacted as an amendment to the code. For the purposes ofthis section general ordinances <br /> shall be deemed to be those ordinances of a permanent or continuing nature which affect the <br /> residents of the city at large. When adopted by the council, the printed codes of general <br /> ordinances contemplated by this section shall be in full force and effect without the necessity <br /> of such code or any part thereof being published in any newspaper. The caption, descriptive <br /> clause, and other formal parts of the ordinances of the city may be omitted without affecting <br /> the validity of such ordinances when they are published as a code. Copies of the code shall <br /> be furnished to city officers, placed in libraries and public offices for free public reference <br /> and made available through electronic media and for purchase by the public at a reasonable <br /> price fixed by the council. <br /> ********** <br /> Rationale: This change will keep the purpose of this Charter provision up to date with <br /> changes in technology. <br />
