Amend subsection (b) of Section 7.01 regarding matters on which members of the <br /> Planning and Zoning Commission are eligible to vote as follows: <br /> (b) All members of the commission shall be eligible to vote on all matters coming <br /> before the commission, unless prohibited by other provisions ollaw. <br /> ********** <br /> Rationale: With the combining of the previously separate Planning Commission and Zoning <br /> Commission, the purpose of this subsection was to make it clear that the members of the <br /> Planning and Zoning Commission who reside in the ETJ can vote on matters such as zoning <br /> that apply only within the city Hmits. This added wording will clarify that laws such as the <br /> conflict of interest statute can preclude a member ITom voting on a matter. <br /> 8. Amend Section 7.06 regarding public hearings required for amendment of the <br /> Master Plan as follows: <br /> Sec. 7.06. The master plan. <br /> The master plan for the physical development of the City of San Marcos shall contain <br /> the recommendations of the planning and zoning commission for growth, development and <br /> beautification of the city. The planning and zoning commission may recommend <br /> amendments to the master plan to the city council after at least one (1) public hearing on the <br /> proposed action. The council may amend the master plan after at least one (1) public hearing <br /> on the proposed action. The council shall not act on any amendment affecting the master plan <br /> unless and until a recommendation on the amendment is received from the commission. <br />
