162 <br />Regular Meeting July 27, 1998 Page 4 <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. Mr. Eric <br />Fleetwood stated he represented Alpha Tau. Omega. Mr. Fleetwood stated if this was <br />approved by the Council they would still need to go to the Planning and Zoning <br />Commission and apply for a permit which places them in a time constraint. Mr. Fleetwood <br />stated they would like to occupy a Commercial piece of property with a specific use permit <br />and it would allow them to operate in a more professional manner as a business and be <br />a part of the San Marcos community. Mr. Fleetwood stated there would possibly be four <br />persons living there and would be used for meetings and all operations. Mr. Fleetwood <br />stated the Planning and Zoning Commission would be placing restrictions as needed. Ms. <br />Ana Mendoza stated she was there on behalf of the Rio Vista Neighborhood and stated <br />she was not opposed to anything the fraternity was planning to do, although she did not <br />approve because it would be involving her neighborhood and the people behind the Katy <br />Station. There were no other speakers so Mayor Moore closed the public hearing. Ms. <br />Hughson moved to deny the adoption of the Ordinance and Mr. Doiron seconded the <br />motion. The following vote was recorded: <br />AYE: Hughson, Doiron, Cox, Hernandez <br />NAY: Mihalkanin, Moore, Moseley <br />The Ordinance was denied. <br />Mayor Moore introduced for consideration a public hearing and adoption of an Ordinance <br />on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DESIGNATING A REINVESTMENT ZONE NO. <br />12 PURSUANT TO CHAPTER 312 OF THE TEXAS TAX CODE <br />CONSISTING OF 159.308 ACRES OF PROPERTY LOCATED <br />ADJACENT TO THE 1100-1300 BLOCKS OF CLOVIS BARKER <br />ROAD AND THE 1100-1200 BLOCKS OF CIVIC CENTER LOOP; <br />MAKING STATUTORY FINDINGS; AND DECLARING AN <br />EFFECTIVE DATE. <br />Mayor Pro-Tem Cox opened the public hearing and asked if anyone wished to speak. <br />There were no speakers so Mr. Cox closed the public hearing. Mr. Gilley reviewed the <br />issues of grant development. Mr. Hernandez moved for approval of the Ordinance and Mr. <br />Moseley seconded the motion. Mr. Gilley stated there was no specific schedule for the <br />road and utility improvements. Discussion ensued. Mr. Gilley stated there appeared to be <br />a discrepancy in the map and would suggest the Council table this item. Mr. Mihalkanin <br />moved to table this item and Mr. Moseley seconded the motion which passed unanimously. <br />Mayor Moore introduced a public hearing amending Section 102.029 of the City Code by <br />adopting the Sector Three Plan. Mayor Moore opened the public hearing and asked if <br />anyone wished to speak. Dr. Francis Horne reviewed his letter of June regarding his <br />dilemma. Dr. Horne stated his nine lots were previously platted into three lots and with the <br />new plan they were changed from Limited Business to a residential classification. Ms. <br />Irene Hindson stated she supported the Sector 3 plan and stressed parks be added to <br />Sector 3 and the purchase of Schulle Canyon be addressed. Ms. Hindson expressed <br />concern regarding the designation of a higher multi-family designation for this area. Ms. <br />Hindson stated it was not appropriate for MF-4. Ms. Hindson stated another concern area <br />behind the corner of Bishop and LBJ being several acres of Commercial zoning. Ms. <br />Hindson stated Planning and Zoning had agreed this was not an appropriate area to have <br />several acres of Commercial which she agreed with. Ms. Hindson stated after driving by <br />she noticed an enormous amount of apartments and townhomes being built and she stated <br />they did not need more multi-family in this area. Ms. Hindson stated if it was possible in <br />light of the negotiations regarding Schulle Canyon she did feel they needed park area <br />which Planning and Zoning had recommended. Ms. Hindson stated there were other areas <br />behind Hillside Ranch she would like the Council to look into. Ms. Hindson stated another
