161 <br />Regular Meeting July 27, 1998 Page 3 <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning <br />Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING A 0.35 ACRE TRACT OF PROPERTY <br />LOCATED AT 614 KNOX STREET, FROM "R-1" (SINGLE-FAMILY <br />DWELLING DISTRICT [LOW DENSITY]) TO "MR" (MOBILE HOME <br />AND RESIDENTIAL DISTRICT); INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. Ms. <br />Theresa Silguero stated she was speaking on behalf of Cruz Jaimes asking for a zoning <br />amendment to place a manufactured home which would be her residence. Ms. Silguero <br />stated she did not feel a manufactured home would be a negative impact on the <br />neighborhood's property value. There were no other speakers so Mayor Moore closed the <br />public hearing. Mr. Hernandez moved to deny the request and Ms. Hughson seconded the <br />motion which passed unanimously. Mr. Mihalkanin suggested the Planning and Zoning <br />Commission should look for a distinctive zoning classification and location to allow <br />manufactured homes and not allow what the City calls mobile homes. <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning <br />Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING A 0.34 ACRE TRACT OF PROPERTY <br />LOCATED AT 711 W. MARTIN LUTHER KING DRIVE, FROM "M" <br />(SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS <br />DISTRICT) TO "DPA" (TWO-FAMILY DWELLING DISTRICT [LOW <br />DENSITY]); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. Ms. Betsy <br />Robertson stated she was there to speak for Vance Elliott who wishes to change the <br />zoning of "M" which is an out of date designation and does not permit any building permits <br />to be built under it. Ms. Robertson stated Mr. Elliott wishes to build a duplex on the lot <br />towards the back to provide green space and lots of parking. There were no other <br />speakers so Mayor Moore closed the public hearing. Mr. Moseley moved for approval of <br />the Zoning Ordinance and Mr. Mihalkanin seconded the motion. Ms. Hughson stated she <br />would like to speak against the zoning request because there appear to be single-family <br />homes at the end of Endicott and MLK and she would not like to see a duplex in the middle <br />of what appears to be R-1 on that particular street. Ms. Hughson stated in the interest of <br />neighborhood integrity and what the Sector I Plan allows she does not think it would be a <br />wise choice. Mr. Cox stated the summary sheet points out the Sector 1 plan advocates <br />the City go from anything going to "R-1" to "R-2" in the transition and does not recommend <br />"DPA ". The Council unanimously voted not to approve the Zoning Ordinance. <br />Mayor Moore introduced for consideration a public hearing and adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 114, ZONING, TO <br />ALLOW A SPECIFIC USE PERMIT FOR FRATERNITY/SORORITY <br />BUILDINGS IN A COMMERCIAL ZONING DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; PROVIDING FOR PENALTIES; AND <br />DECLARING AN EMERGENCY.
