45 Regular Meeting March 16, 1998 Page 5 AN ORDINANCE OF THE CITY COUNCil., OF THE CITY OF SAN MARCOS, TEXAS, PROVIDING FOR IMMOBil.,IZING AND IMPOUNDMENT OF VEHICLES WITH THREE OR MORE UNPAID PARKING VIOLATIONS BY AMENDING ARTICLE 4, STOPPING, STANDING, PARKING OF CHAPTER 82, TRAFFIC AND VEHICLES, OF THE SAN MARCOS CITY CODE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mr. Guerra moved to table the Ordinance on second reading and Mr. Hernandez seconded the motion. On roll call the following vote was recorded: AYE: Mihalkanin, Guerra, Hernandez. NAY: Hughson, Hart, Moore, Cox. ABSTAIN: None. Motion fails. Mr. Hart moved for approval of the Ordinance on second reading and Ms. Hughson seconded the motion. On roll call the following vote was recorded: A YE: Hughson, Hart, Moore, Cox. NAY: Mihalkanin, Guerra, Hernandez. ABSTAIN: None. Motion passes. Mayor Moore introduced for consideration Item 9.B., approval of an Ordinance on second reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCil., OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE 4, WRECKERS, OF CHAPTER 90, VEHICLES FOR HIRE, OF THE CITY CODE TO DIVIDE THE ARTICLE INTO TWO DIVISIONS, ONE CONSISTING OF CURRENT REGULATIONS FOR POLICE DEPARTMENT INITIATED TOWS; AND THE OTHER BEING A NEW DIVISION REGULATING THE RATES FOR NONCONSENT TOWS FROM PRIVATE PARKING FACil.,ITIES; SETTING THE MAXIMUM AMOUNTS OF THESE RATES; INCLUDING PROCEDURAL PROVISIONS AND PROVIDING FOR PENALTIES. Mr. Guerra moved to table the Ordinance on second reading and Mr. Hernandez seconded the motion, which passed unanimously. Mayor Moore introduced for consideration Item 11.B., adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCil., OF THE CITY OF SAN MARCOS, TEXAS, AWARDING A CONTRACT FOR THE PURCHASE OF RELAYED SUBSTATION RECLOSERS TO ; AUTHORIZING THE PURCHASING MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. Mr. Hart moved for adoption of the Resolution and Mr. Cox seconded the motion. Mayor Moore explained there was a tie bid and the Council was to draw lots for the award. The Council awarded the bid to KBS Electrical Distributors, Inc. Mr. Hart amended his motion to add KBS Electrical Distributors, Inc., to the blanks in the Resolution and Mr. Cox seconded his motion, which passed unanimously.
