9. <br />Regular Meeting May 11, 1998 Page 2 <br />Mayor Moore introduced for consideration a public hearing and approval of an Ordinance on first <br />reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 114.001 AND DIVISION 13 OF ARTICLE 5 OF THE <br />ZONING CHAPTER OF THE CITY CODE TO REPLACE THE "MF-1"; MULTI- <br />FAMILY DISTRICT (LOW DENSITY) WITH A "CH" CLUSTER HOUSING <br />DISTRICT (LOW DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. There were no <br />speakers so Mayor Moore closed the public hearing. Ms. Hughson moved for approval of the <br />Ordinance on first reading and Mr. Mihalkanin seconded the motion. Mr. Taylor stated there was <br />an error in Section 114.306 (5) which should be "group homes". Mr. Guerra asked if condos <br />were allowed in cluster housing and Mr. Patterson stated that was correct. Mr. Guerra asked if a <br />lodging house was considered a boarding house and Mr. Patterson stated that was correct. Mr. <br />Cox asked if the Day Care Centers were for residents only. Mr. Patterson explained that was the <br />intent; however, the wording in the Ordinance would allow non-residents. Ms. Hughson stated <br />the maintenance on the greenbelts could be a problem. Mr. Patterson explained an association <br />would have to be formed to care for the greenbelts. Ms. Hughson moved to amend Section <br />114.306 to omit condos and lodging house. Motion failed for lack of a second. Mr. Guerra <br />stated concern with the Ordinance being designed for the Oak Heights neighborhood and <br />suggested visiting with other neighborhood associations for their input. Mr. Guerra moved to <br />table the Ordinance until the staff could involve input from other organizations and Mr. <br />Hernandez seconded the motion. On roll call the following vote was recorded: <br />AYE: Hughson, Hart, Guerra, Cox, Hernandez. <br />NAY: Mihalkanin, Moore. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration a public hearing and adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 114.487 OF THE ZONING CHAPTER OF THE SAN <br />MARCOS CITY CODE TO ADD CHURCHES AS A SPECIFIC USE ALLOWED IN <br />"C" COMMERCIAL DISTRICTS; INCLUDING PROCEDURAL PROVISIONS; <br />PROVIDING FOR PENALTIES; AND DECLARING AN EMERGENCY. <br />Mayor. Moore opened the public hearing and asked if anyone wished to speak. Bucky Couch, <br />Solid Rock Baptist Church, recommended the Council support this Ordinance. There were no <br />other speakers so Mayor Moore closed the public hearing. Mr. Guerra moved for adoption of the <br />Ordinance on emergency and Mr. Hart seconded the motion, which passed unanimously. <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning Ordinance, <br />the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 1.0 ACRE TRACT OF PROPERTY LOCATED IN THE 1200 BLOCK OF UHLAND <br />ROAD FROM "PD" PRE-DEVELOPMENT DISTRICT TO "MF-4" MULTI-FAMILY <br />DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. Jim Byrn stated <br />he was representing the Dobies and was available to answer any questions. There were no other <br />speakers so Mayor Moore closed the public hearing. Mr. Cox moved for adoption of the Zoning
