<br />153 <br />Regular Meeting October 26; 1998 Page 2 <br />AYE: Doiron, Moore, Moseley, Cox, Mihalkanin, Hughson. <br />NAY: Hernandez. <br />ABSTAIN: None. <br />Mayor Moore introduced an Ordinance on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING ARTICLE 2, FAIR HOUSING, OF CHAPTER 46, HUMAN <br />RELATIONS, OF THE CITY CODE TO UPDATE THE CITY'S FAIR HOUSING <br />REGULATIONS; INCLUDING PROCEDURAL PROVISIONS; PROVIDING FOR <br />PENALTIES; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Hernandez moved for approval of the Ordinance on first reading and Mr. Mihalkanin <br />seconded the motion, which passed unanimously. <br />Mayor Moore introduced an Ordinance to be removed from the table and considered on third and <br />final reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING ARTICLE 3, BOARDS, COMMITTEES AND COMMISSIONS, <br />OF CHAPTER 2, ADMINISTRATION, OF THE CITY CODE BY ADDING A <br />DIVISION 16 TO ESTABLISH A NEW ARTS COMMISSION; AMENDING CITY <br />CODE SECTION 2.352(b) TO REMOVE OVERSIGHT OF ARTS FUNDING FROM <br />THE DUTIES OF THE CONVENTION AND VISITORS BUREAU BOARD; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mr. Mihalkanin moved for removal from the table and approval of the Ordinance on third and <br />final reading and Mr. Doiron seconded the motion. Ms. Hughson moved to amend Section 2.361 <br />(b) to add "In consultation with the arts community,..." and Mr. Mihalkanin seconded the motion, <br />which passed unanimously. Mayor Moore moved to amend Section 2.360 (b) to read "The City <br />Council wi1l endeavor to appoint persons to this commission who represent a variety of artistic <br />interests..." and Mr. Hernandez seconded the motion. Mayor Moore and Mr. Hernandez <br />withdrew the motion. Mayor Moore then moved to amend Section 2.360 (b) to read, " The City <br />Council wi1l endeavor to appoint persons to this commission who represent a variety of the <br />arts..." and Mr. Doiron seconded the motion, which passed unanimously. The Council then <br />voted unanimously for adoption of the Ordinance on third and final reading. <br />Mayor Moore introduced for consideration the consent agenda including approval of the Minutes <br />of the Regular Meeting held October 12, 1998, approval of the Minutes of an Emergency <br />Meeting held October 21, 1998, approval of three Ordinances on second reading, approval of one <br />Ordinance on third and final reading, approval to remove from the table and adopt one Ordinance <br />on third and final reading, and adoption of eight Resolutions on consensus. The Council <br />removed items 8.B. (1), adoption of the Minutes of the Regular Meeting held October 12, 1998; <br />8.C., adoption of an Ordinance on third and final reading and 8.E. (6), adoption of a Resolution, <br />to be considered separately. Mr. Mihalkanin moved for approval of the Minutes of the <br />Emergency Meeting held October 21, 1998 (Mr. Doiron abstaining), approval of the three <br />Ordinances on second reading, removal from the table and adoption of an Ordinance on third and <br />final reading and adoption of the remaining seven Resolutions on consensus. Mr. Hernandez <br />seconded the motion, which passed unanimously (Mr. Doiron abstained to minutes of Emergency <br />Meeting held October 21, 1998; Mr. Moseley voting Nay to Item S.B [1], approval of Ordinance <br />on second reading; Ms. Hughson and Nlr. Doiron voting Nay to Item S.B. [5], adoption of <br />Resolution). The caption of these Ordinances and Resolutions read as follows: <br />Approval of Ordinances on second reading: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 97.773 <br />---- <br />
