97 <br />Regular Meeting September 28, 1998 <br />Page 5 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS INCREASING WATER RATES ESTABLISHED UNDER SECTION <br />86.231 OF THE SAN MARCOS CITY CODE; ESTABLISHING LIFELINE <br />RATES FOR WATER AND WASTEWATER SERVICES UNDER SECTIONS <br />86.231 AND 86.262 OF THE SAN MARCOS CITY CODE; AND <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />Mr. Doiron moved to deny the Ordinance, and there was no second. <br />Mr. Hernandez moved for adoption of the Ordinance on emergency <br />and to include revisions contained in Mr. Taylor's memorandum <br />and Mr. Cox seconded the motion. On roll call the following <br />vote was recorded: <br />AYE: Hughson, Moore, Cox, Hernandez. <br />NAY: Mihalkanin, Doiron, Moseley. <br />ABSTAIN: None. <br />The Ordinance passed on third and final reading rather than on <br />emergency, because only four votes were received. The effective <br />date will be ten days rather than on emergency (publication <br />date). <br />Mayor Moore introduced for consideration adoption of an <br />Ordinance on emergency, the caption which was read as follows: <br />AN ORDINANCE AUTHORIZING AND ALLOWING, UNDER THE ACT <br />GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM, "UPDATED <br />SERVICE CREDITS" IN SAID SYSTEM ON AN ANNUAL BASIS FOR <br />SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM WHO <br />AT THE EFFECTIVE DATE OF THE ALLOWANCE ARE IN THE <br />EMPLOYMENT OF THE CITY OF SAN MARCOS; PROVIDING FOR <br />INCREASED PRIOR AND CURRENT SERVICE ANNUITIES FOR RETIREES <br />AND BENEFICIARIES OF DECEASED RETIREES OF THE CITY; TO <br />INCREASE THE RATE OF DEPOSITS TO THE TEXAS MUNICIPAL <br />RETIREMENT SYSTEM BY THE EMPLOYEES OF THE CITY; AND <br />DECLARING AN EMERGENCY. <br />Mr. Hernandez moved for adoption of the Ordinance on emergency <br />and Mr. Mihalkanin seconded the motion, which passed <br />unanimously. <br />Mayor Pro-Tem Cox introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 34, ENVIRONMENT, OF THE SAN MARCOS <br />CITY CODE BY PROVIDING MUNICIPAL COURT CITATION AUTHORITY <br />TO CITY SANITARIANS; PROVIDING FOR PROPERTY OCCUPANTS TO BE <br />RESPONSIBLE FOR WEEDY LOT AND JUNKED VEHICLE VIOLATIONS; <br />AND CLARIFYING THE DEFINITION OF "JUNKED VEHICLES" AND <br />ACTIONS CONSTITUTING A VIOLATION OF THIS CHAPTER; INCLUDING <br />PROCEDURAL PROVISIONS AND PROVIDING FOR PENALTIES. <br />Ms. Hughson moved for approval of the Ordinance on first reading <br />and Mr. Mihalkanin seconded the motion, which passed unanimously <br />(Mayor Moore not present to vote on this item).
