96 <br />Regular Meeting September 28, 1998 <br />Page 4 <br />DISTRICT) TO "LB" (LIMITED BUSINESS DISTRICT); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished <br />to speak. No one did, so Mayor Moore closed the public hearing. <br />Ms. Hughson moved for adoption of the Zoning Ordinance and Mr. <br />Doiron seconded the motion, which passed unanimously. <br />Mayor Moore introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING A 0.76 ACRE TRACT OF PROPERTY LOCATED AT 317 <br />BLANCO STREET, FROM "P" (PUBLIC AND INSTITUTIONAL DISTRICT) <br />TO "MF-2" (MULTI-FAMILY DISTRICT [MEDIUM DENSITY]); <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished <br />to speak,. Dale Grayson wants the property rezoned to MF-2 and <br />wants to place ten units on the property. The Planning and <br />Zoning Commission denied this zoning and therefore, it will take <br />six votes of the City Council to overturn that decision. Mr. <br />Cox moved to deny the zoning request and Ms. Hughson seconded <br />the motion. On roll call the following vote was recorded: <br />AYE: Mihalkanin, Hughson, Doiron, Moseley, Cox. <br />NAY: Moore, Hernandez. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration a public hearing and <br />approval of an Ordinance on first reading, the caption which was <br />read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE ABANDONMENT OF A PART OF THE UNOPENED <br />PORTION OF TRAVIS STREET LOCATED BETWEEN BELVIN STREET AND <br />BURLESON STREET; APPROVING THE CONVEYANCE OF THIS PORTION <br />OF TRAVIS STREET TO KERMIT WELCH AND CHARLES S. MEEKS; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND <br />DECLARING AN EFFECTIVE DATE. <br />Mayor Moore opened the public hearing and asked if anyone wished <br />to speak. No one did, so Mayor Moore closed the public hearing. <br />Mr. Gilley stated the City wants to retain utility easements. <br />Mr. Hernandez asked if we might want to retain this for future <br />access. Mr. Gilley stated we could enter into a license <br />agreement and not give up ownership, which Mr. Hernandez stated <br />is a better way to go. Mr. Mihalkanin moved to deny the <br />abandonment and Mr. Hernandez seconded the motion. On roll call <br />the following vote as recorded: <br />AYE: Mihalkanin, Doiron, Moore, Moseley, Cox, Hernandez. <br />NAY: Hughson. <br />ABSTAIN: None. <br />Mayor Moore introduced for consideration adoption of an <br />Ordinance on emergency, the caption which was read as follows:
