<br /> 46. <br />Regular Meeting February 26, 2001 Page 5 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> APPROVING A CONVEYANCE, ASSIGNMENT AND BILL OF SALE FROM HAYS ENERGY <br /> LIMITED PARTNERSHIP TO THE CITY REGARDING THE WATER SUPPLY AND <br /> WASTEWATER SERVICE LINES FOR THE HAYS ENERGY LIMITED PARTNERSHIP <br /> POWER PLANT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE INSTRUMENT; <br /> AND DECLARING AN EFFECTIVE DATE. <br />Mayor Chiu introduced for consideration Item 14 removed from the consent <br />agenda, approval of an Ordinance on second reading, the caption which was <br />read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> AMENDING SECTIONS 42.001, 42.076 AND 42.129, AND ADDING AN ARTICLE 5, <br /> TAX INCENTIVES, OF CHAPTER 42, HISTORIC PRESERVATION, OF THE CITY <br /> CODE TO PROVIDE TAX INCENTIVES FOR THE PRESERVATION OF HISTORIC <br /> BUILDINGS; AND INCLUDING PROCEDURAL PROVISIONS. <br />Mr. Moseley moved for approval of the Ordinance on second reading and Mr. <br />Mayhew seconded the motion. Ms. Hughson stated the Council should table <br />the Ordinance until the changes that were discussed at first reading are <br />reflected. Ms. Hughson expressed concern for the cost to the City for <br />this program, less income will be generated to the City and there are <br />homes that will not qualify for the tax incentive. Mayor Chiu requested <br />the Historic Preservation Commission look at the suggested revisions with <br />the new version. Mayor Chiu stated with this Ordinance, the biggest <br />concern is the net revenue loss to the City. The Commission can look at <br />how best to proceed, as we need a different solution. Mr. Moseley stated <br />Mr. Taylor's revisions need to be provided to the Commission and some of <br />the suggestions need to be incorporated. Mr. Cox stated the biggest issue <br />is financial. In the long run this will actually generate more revenue, <br />and in the short term there will be a loss of revenue. Mr. Kester stated <br />the Commission does not have any statistical data regarding the value of <br />previous restoration permits. Mr. Cox stated he is supportive of the <br />principle of the Ordinance and wants the Commission to be asked to bring <br />back their revisions by a certain time to not lose the momentum of the <br />Ordinance. Mayor Chiu asked Mr. Kester if two months would be sufficient <br />time. Mr. Kester indicated it would be time enough for the Commission, <br />but they will need the Planning Department to provide data, so it will <br />also depend on if time permits the Planning Department to work on this <br />project. Mr. Cox stated he was not suggesting a lot of time be spent <br />developing data if it is not available, but will need some attention to <br />address the financial issue. Ms. Tatum asked how many homes would <br />qualify, and Mr. Kester stated they did not have a number. Mr. Moseley <br />asked if a number could be provided of homes that might qualify and <br />include the downtown area as well. Mr. Kester stated he thinks the tax <br />incentive would mostly be used by the downtown area. Mr. Kester stated <br />they have surveyed the west end, Dunbar Neighborhood, East and South of <br />Guadalupe and need to look at one or two other areas that would qualify. <br />Mr. Moseley moved to table the Ordinance for a period of ninety days for <br />the Historic Preservation Commission to modify the Ordinance and review <br />
