Ms. Hughson stated <br />the Council may need to set a maximum to go to this project to abate <br />annually. Mr. Kester requested the Council make the list as explicit as <br />possible and a written list would be very beneficial. <br />Mayor Chiu introduced for consideration Item 16 removed from the consent <br />agenda, remove from table and consider adoption of Ordinance on third and <br />final reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> AMENDING ARTICLE 2 OF CHAPTER 74 OF THE CITY CODE TO ADD A NEW <br /> DIVISION 4 REGARDING OBSTRUCTIONS IN ALLEYS; AND INCLUDING PROCEDURAL <br /> PROVISIONS. <br />Mr. Moseley moved for adoption of the Ordinance on third and final reading <br />and Ms. Tatum seconded the motion. Mr. Moseley requested Mr. Schneider be <br />allowed to make comments addressing this Ordinance. Mr. Schneider stated <br />as a builder in the Westover area, he has fenced 7.5 feet of IS-foot <br />alleys to keep trash out of the alleys. He is opposed to having to remove <br />those fences from the alleys. Mr. Cox stated he wanted to review the <br />issue that Mr. Swart brought to the Council's attention and which Mr. Cox <br />stated the Council had recognized the need to address the issue as a <br />public policy question. Mr. Swart has a water well adjacent to an alley <br />and has difficulty accessing the well because his neighbor has built a <br />fence enclosing part of the alley. Mr. Swart stated he has a well <br />adjacent to an alley, and when the well needs servicing, access is needed <br />through the alley. Mr. Swart stated he thinks he should have the right of <br />access and his neighbor does not want to remove the fence. If alleys are <br />left unfenced and unobstructed, they remain the City's responsibility. If <br />fenced the neighbors would maintain. Ms. Hughson stated the City must <br />formalize a policy and agrees with Mr. Schneider that there will be less <br />maintenance for the City when fences are placed. Ms. Hughson questioned <br />if a fence could be placed unless a neighbor objected. There would need <br />to be a formal process developed. Mr. Doiron stated the Council will need <br />to determine what methodology to use. Mayor Chiu stated the language <br />needs to be revised to allow a fence if there are no objections from the <br />neighbors and formalize this process. Mr. Cox stated the Council would <br />still need to determine with Ms. Hughson's proposal if an existing fence <br />would need to be taken down. Mr. Moseley moved to table the Ordinance for <br />revision and Mr. Doiron seconded the motion, which passed unanimously. <br />Mayor Chiu introduced for consideration Item 17 removed from the consent <br />agenda, adoption of a Resolution, the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> CHANGING THE TITLE OF THE "BOND OVERSIGHT COMMITTEE" TO THE "BOND <br /> ADVISORY COMMITTEE"; AND DECLARING AN EFFECTIVE DATE. <br />
