iv. Property Acquisition. The City shall be responsible for <br />acquiring all off-site easements or land associated with Wastewater Impact <br />Fee Project. However, the Developer, with the City's approval, may acquire <br />any required off-site easements or land, in which event the City will <br />reimburse the Developer for the cost of such acquisitions with the City's <br />reimbursement to the Developer under Subsection (iii) above. <br />V. Pro Rata Share. For the purposes of subsection <br />4.03(a)(2)(iii), the Developer's pro rata share is defined as the wastewater <br />flow generated by the Property divided by the total wastewater flow <br />generated by the total basin being served by the regional lift station and <br />force main as calculated in the City's Master Wastewater Plan by Friese and <br />Nichols dated December 2014. <br />b. Dedication of Easements within the Property. It is understood by the <br />Owners and the Developer that easements or land associated with the Water and the <br />Wastewater Impact Fee Projects within the Property will be located in the approximate <br />locations shown in Exhibit "D-2" but that no surveys of such easement areas are presently <br />available. In consideration of the blanket easement dedicated by the City under Section <br />3.03, the Owners hereby dedicate to the City a blanket easement across the previously <br />mentioned 160.2 acre tract and the 171.80 and 237.06 acre tracts shown in Exhibit "A", <br />save and except any portion of such three tracts contained within the Katerra Tract, for the <br />installation, operation, maintenance, repair and replacement of, and vehicular access to, the <br />facilities associated with the Water and Wastewater Impact Fee Projects in the approximate <br />locations shown on Exhibit "D-2".
