shall release such platted portions from the blanket easement if. (i) the platted area is <br />outside the proposed location of any such facilities and associated access areas; or (ii) the <br />plat dedicates a smaller specific easement area, including associated access areas, for the <br />facilities. The dedication of easements within the Property by the Developer will be at no <br />cost to the City. It is understood and agreed by the City that current uses on the Property <br />(and uses of the Property permitted by the City, including other utility crossings, rail lines <br />and driveways, may continue and are deemed not to interfere with the blanket easement <br />granted hereunder. <br />C. Water CCN Exchange. The City will consider an agreement with <br />Maxwell Water Supply Corporation to trade or otherwise exchange water CCN areas under <br />mutually agreed terms and subject to approval by the Texas Public Utility Commission. <br />d. Adequate Public Facilities (Wastewater). Wastewater service is to be <br />provided through a centralized wastewater system. Provision for temporary on-site sewage <br />facilities may be approved under Section 3.5.2.1 of the City's Development Code. <br />e. Other Owners. It is expressly agreed that all of the obligations of <br />Developer set forth under this Section 4.03 are personal to Developer and shall not bind <br />Future Owners of any portion of the Property, except as provided in Section 4.04. <br />Nonetheless, if the Developer fails to comply with this Section 4.03, any Owner or Future <br />Owner of any portion of the Property may undertake the Developer's obligations under this <br />Section 4.03. In such event, such Owner or Future Owner shall be entitled to <br />reimbursement by the City in accordance with this Section 4.03. <br />Section 4.04. No Waiver of Platting Requirements.
