ARTICLE V <br />DEVELOPMENTSTANDARDS <br />Section 5.01. Building and Development Code Compliance. Except as specifically <br />waived in Article VI, or any agreements approved by the City related to development on the <br />Property, all phases of development and construction on the Property shall be subject to <br />compliance with the City's utility, building and development ordinances, including Chapters 14, <br />38, 39, 86 and Subpart B of the City's Code of Ordinances. Such compliance shall include consent <br />to building permitting and inspections by the City, and payment of any application fees, impact <br />fees, permit fees and inspection fees and the City's issuance of certificates of occupancy with <br />respect to any development on the Property shall be considered on the basis of this Agreement as <br />long as the development complies with the City's ordinances referenced above as modified by this <br />Agreement. <br />Section 5.02. Enhanced Water Quality Safeguards. Development of the Property shall <br />adhere to the supplemental water quality standards under this section. Measures shall be <br />implemented by the Developer applying applicable best management practices ("BMP's") to <br />ensure that, after full development of the Property, at least 70 percent of increased total suspended <br />solids are removed from stormwater and a water quality volume produced by a 1.25 -inch rainfall <br />is captured. The water quality volume will provide stream protection to preserve the natural <br />character of downstream waterways. Appropriate stormwater treatment measures include: the use <br />of de -centralized, low impact development features (e.g., rain gardens, pervious pavement, <br />biofiltration, etc.), stormwater detention facilities and extended detention basins. The City's <br />Stormwater Technical Manual in effect on the Effective Date of this Agreement shall govern or <br />guide, as applicable, BMP selection and design, except for the changes to such manual (if any) <br />that fall within the exemptions listed under Section 245.004 of the Texas Local Government Code. <br />14 <br />065611.00495 309237v15 <br />
